<br />Removal of Channel Obstructions <br /> <br />Debris build-ups are a continual problem on Colorado . <br />streams. These materials consist of organic and inorganic <br />matter. The Corps of Engineers' clearing and dragging authority <br />has been difficult to impleme~t because of the difficulty in <br />demonstrating a positive cost/benefit relationship. Legislation <br />enacted in 1974 authorizes the county commissioners to remove <br />obstructions in any natural stream channel for flood control <br />purposes. This legislation also established a grants fund within <br />the ewCB; however, funds were never appropr iated to the fund. <br /> <br />Corps' 404 Permit Review Process - <br /> <br />This a federal program which is coordinated by the Colorado <br />Department of Health. No floodplain permitting progralll exists <br />within the State for flood-related issues or concerns. <br /> <br />Disaster Response and Recovery Operations <br /> <br />The General Assembly in 1973 enacted legislation Which <br />established the Colorado Division of Disaster Emerge:ncy Services. <br />DODES. This agency handles all of the States I natural and <br />man-made disasters. Floods contribute to approximat.ely 80% of <br />all disaster declarations. This agency has developed a State <br />response plan which uses the resources of all the St,ate <br />agencies. Their operations address all aspects of ~~ergency <br />response activities. <br /> <br />Technical Assistance and Reviews <br /> <br />. <br /> <br />The legislation which was enacted by H.B. 1041 in 1974 and <br />S. B. 35 in 1973 developed a partnership between the state <br />agencies and local governments. These partnerships affbrded <br />communities the opportunity to obtain technical eval.uations on <br />complex issues. The intent of the legislation was 1:0 develop a <br />review procedure which would reduce and mitigate losses frern <br />natural disasters. Most of these partnerships will be terminated <br />as a result of the 1983 General Assembly budget cuts to state <br />agencies for these activities Which were assisting local <br />governments on technical matters. The cut were mad.~ in resp:>nse <br />to the financial problems which the State is experi,mcing. <br /> <br />Executive Order 8491 and 8504 - <br /> <br />These orders are mandates to all state agencies that flood <br />hazards must be evaluated, When state funds are to be spent in <br />floodplains. The purpose of the evaluations is to lessen the <br />flood risks to State financed structures and activities. The <br />CWCB I s staff provides the technical assistance to t'"e State <br />agencies for the implementation of these orders. <br /> <br />The attached table will provide you with the specific <br />statute citation numbers and a brief summary of the statutory <br />language. <br /> <br />. <br /> <br />-4- <br />
