<br />Local Request for Designation <br /> <br />WHEREAS, Teller County and the City of Woodland Park have requested the Colorado <br />Water Conservation Board to designate and approve the detailed and approximate floodplain <br />information contained in said new report; and <br /> <br />WHEREAS, the City of Cripple Creek has requested the Colorado Water Conservation <br />specifically to omit from designation and approval the approximate floodplain information <br />contained in said new report for those portions of Cripple Creek, Poverty Gulch and Pony Gulch <br />within the corporate limits of the City of Cripple Creek, as they were on September 30, 1988; <br />and <br /> <br />WHEREAS, there is a need to have accurate floodplain information to guide land use <br />and permitting decisions in the City of Cripple Creek; and <br /> <br />C.R.S. Authority <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; <br />and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide <br />that legislative bodies of local jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after designation and approval by <br />the Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or <br />basins and to make such designations available to legislative bodies oflocal jurisdictions; and <br /> <br />Compliance with CWCR Technical Standards <br /> <br />WHEREAS, the estimation of 100-year flows for all of the approximate floodplains for <br />the stream reaches described in said new report, except for the floodplains for stream reaches <br />with basins that are not within the range of applicability of the Guidelines, of stream reaches <br />which lie within South Platte River basin Subregion SPL-5 and of local storm drainage areas, <br />lakes, ponds, reservoirs and overflows from irrigation ditches, is described in the Hydrology <br />Addendum for Approximate Floodplains dated March 1997, hereby attached to said new report <br />dated September 30, 1988; and <br /> <br />WHEREAS, the detailed floodplain information in said new report for the stream <br />reaches listed in Table 1 meets the requirements for detailed information listed under the <br /> <br />13 <br />
