Local Request for Designation

WHEREAS, Teller County and the City of Woodland Park have requested the Colorado
Water Conservation Board to designate and approve the detailed and approximate floodplain
information contained in said new report; and

WHEREAS, the City of Cripple Creek has requested the Colorado Water Conservation
specifically to omit from designation and approval the approximate floodplain information
contained in said new report for those portions of Cripple Creek, Poverty Gulch and Pony Gulch
within the corporate limits of the City of Cripple Creek, as they were on September 30, 1988;
and

WHEREAS, there is a need to have accurate floodplain information to guide land use
and permitting decisions in the City of Cripple Creek; and

C.R.S. Authority

WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado
Water Conservation Board to assist in the prevention of floods and flood damages therefrom;
and

WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide
that legislative bodies of local jurisdictions may provide zoning regulations for land uses on or
along any storm or floodwater runoff channel or basin only after designation and approval by
the Colorado Water Conservation Board; and

WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado
Water Conservation Board to designate and approve storm or floodwater runoff channels or
basins and to make such designations available to legislative bodies oflocal jurisdictions; and

Compliance with CWCR Technical Standards

WHEREAS, the estimation of 100-year flows for all of the approximate floodplains for
the stream reaches described in said new report, except for the floodplains for stream reaches
with basins that are not within the range of applicability of the Guidelines, of stream reaches
which lie within South Platte River basin Subregion SPL-5 and of local storm drainage areas,
lakes, ponds, reservoirs and overflows from irrigation ditches, is described in the Hydrology
Addendum for Approximate Floodplains dated March 1997, hereby attached to said new report
dated September 30, 1988; and

WHEREAS, the detailed floodplain information in said new report for the stream
reaches listed in Table 1 meets the requirements for detailed information listed under the
