Box 1580, Albuquerque, New Mexico 87103, within thirty (30) days <br />Unon receipt of a written request therefor from an authorized representative <br />of the Albuquerque District. "Rights-of-way" comprise all land needed for <br />the construction of the Project, including easements required for flood- <br />zoning purposes in ponding areas and the relocation of any railroads, <br />utilities, roads, streets, canals, drains, levees and any other publicly or <br />privately owned property and facilities according to the requirements of <br />the Corps of Engineers; <br />b. That the District promises to hold and save the Government <br />free and harmless from damages for injury caused to persons or loss to <br />property due to the construction works. which obligation shall extend to <br />works which are auxiliary or incidental to the Project; <br />c. That the District will at least annually inform individuals <br />concerned about the residual flood problem involved owing to temporary <br />ponding; <br /> <br />, <br /> <br />d. That the District will prevent encroachment on the Arkansas <br />River channel which would reduce the design flow capacity through the leveed <br />section and in the ponding areas and interior drains; and, if ponding area <br />capacity is impaired, provide substitute storage capacity or equivalent <br />pumping capacity without cost to the Government; <br />e. That the District will make any alterations to existing im- <br />provements, other than railroad bridges and approaches in connection there- <br />with, which may be required because of the Project; <br />f. That the District will maintain and operate all the works <br />after comoletion, including the overbank clearing under and between the <br />new highway bridge and the existing railroad bridge, in accordance with <br />regulations prescribed by the Secretary of the Army; <br />g. That the District assures the Government that it has autho- <br />rity to issue bonds, to borrow money, and the power to levy tax assessments <br />on real property. and that by such or other means, singly or conlbined, a <br />sufficient sum of money will be made available to meet all financial obli- <br />gations of the District arising from this Project; and <br />h. That if requested by the Government, the District will furnish <br />evidence' of title reflecting a sufficient property interest 1n the flood <br /> <br />3 <br />
