Prevent encroachrent on the river channel. which would reduce the <br />design fl~J capacity through the leveed section and on the ponding areas <br />and interior drains; and if ponding area capacity is impaired, provide sub- <br />stitute storage capacity or equivalent pumping capacity promptly without <br />cost to the Government: <br />e. Make any alterations to existing improvements, other than railroad <br />bridges and approaches in connection therewith, which may be required be- <br />cause of the Project: and <br />f. Maintain and operate the works after completion, including the <br />overbank clearing under and between the new highway bridge and the existing <br />railroad bridge, in accordance with regulations prescribed by the Secretary <br />of 'the Army: and <br />WHEREAS, Section 207 of the Uniform Relocation Assistance and Real <br />Property Acquisition Policies Act of 1970, Public Law 91-646, hereinafter <br />referred to as the Relocation Assistance Act, requires that the local spon- <br />sor, in furnishing real property incident to Federal assistance, make all <br />payments and provide all assistance and assurance provided by Sections 210 <br />and 305 of the Act; and <br />WHEREAS, the District hereby represents that it has the authority and <br />capability to furnish the non-Federal cooperation required by the Federal <br />legislation authorizing the Project, Public Laws 91-611, 91-646, and other <br />applicable laws. <br />NOW, THEREFORE, the parties agree as follows: <br />1. The District agrees that if the Government shall undertake con- <br />struction of the flood protection works substantially in accordance with <br />the Federal legislation authorizing such project, the District shall, in <br />consideration of the Government undertaking the construction thereof, <br />fulfill the requirements of non-Federal cooperation specified in such <br />legislation, to wit: <br />a. That the District does hereby guarantee and promise the Govern- <br />ment that it will furnish, without cost to the Government, all lands, ease- <br />ments and rights-of-way necessary for the entry upon and construction and <br />operation of the Project, evidence of which shall be made available to the <br />Albuquerque Dhtrlct, Corps of Engineers, United States Department of the <br /> <br /> <br />2 <br />
