the ARKANSAS RIVER COIISERVANCY DISTRICT, a public corporation of the State

of Colorado, hereinafter called the "District,"

WInIESSETH:
I/IIEREAS, the District desires to cooperate with the Government in con-
structing flood protection works against destructive flood waters emanating
from the ARKAtISAS RIVER AllO TRIBUTARIES at and in the vicinity of Las Animas,
Colorado, which flood protection works herelnafter sometimes called the
"Project," are being undertaken by the United States as set forth in Section
204, Title II, of the Flood Control Act of 1965, Public Law 89-298, approved
October 27, 1965: and
WHEREAS, Section 221 of the Flood Control Act of 1970, Public Law

91-6'1, requires a written a9reement for projects involvlng construction
that commences on or after January I, 1972: and

\lHEREAS, Section 204 of Public Law 89-29B calls for assurances that
the District will:

a. Provide without cost to the United States all lands, easements,
and rights-of-way necessary for construction of the Project, includin9
easements required for flood-zoning purposes in the ponding area;
b. Hold and save the United States free from damages due to the con-

struction werk.

c. At least annually inform individuals concerned about the residual

flood oroblem involved owing to temporary ponding:
