<br />, <br />, <br /> <br />AGREEMENT BEn/EEN <br />THE UNITED STATES OF AMERICA <br />AIID <br />TIlE ARKANSAS RIVER COIISERVANCY DISTRICT, <br />LAS AIlIMAS, BEIlT CDUIlTY, COLORADO <br />FOR COOPERATlOII \11TH TIlE, UNITED STATES OF AMERICA <br />IN FLOOD CONTROL \lORKS <br /> <br />THIS AGREEME1n entered into this Jd:Jl{;day of <br />by and between the UNITED STATES OF AI1ERICA, herel <br /> <br /> <br />1973 <br /> <br />the "Govern- <br /> <br />ment," represented by the Contracti n9 Offi cer executi n9 this a9reement, and <br /> <br /> <br />the ARKANSAS RIVER COIISERVANCY DISTRICT, a public corporation of the State <br /> <br />~ <br /> <br />of Colorado, hereinafter called the "District," <br /> <br />WInIESSETH: <br />I/IIEREAS, the District desires to cooperate with the Government in con- <br />structing flood protection works against destructive flood waters emanating <br />from the ARKAtISAS RIVER AllO TRIBUTARIES at and in the vicinity of Las Animas, <br />Colorado, which flood protection works herelnafter sometimes called the <br />"Project," are being undertaken by the United States as set forth in Section <br />204, Title II, of the Flood Control Act of 1965, Public Law 89-298, approved <br />October 27, 1965: and <br />WHEREAS, Section 221 of the Flood Control Act of 1970, Public Law <br /> <br />91-6'1, requires a written a9reement for projects involvlng construction <br />that commences on or after January I, 1972: and <br /> <br />\lHEREAS, Section 204 of Public Law 89-29B calls for assurances that <br />the District will: <br /> <br />a. Provide without cost to the United States all lands, easements, <br />and rights-of-way necessary for construction of the Project, includin9 <br />easements required for flood-zoning purposes in the ponding area; <br />b. Hold and save the United States free from damages due to the con- <br /> <br />struction werk. <br /> <br />c. At least annually inform individuals concerned about the residual <br /> <br />flood oroblem involved owing to temporary ponding: <br /> <br />. <br />
