The proportionate contribu- <br />tion for off-site drainage facilities shall be determined by the <br />(name of city or county) and shall be based on an estimate of the <br />hydrologic impact of the development as outlined in Section 21.05.04. <br />The city (or county) may require the owner/developer to pay an off- <br />site drainage fee (ODF) as determined under Section 21.05.04 for the <br />proposed subdivision, or it may require the construction of necessary <br />off-site drainage facilities that traverse through, are adjacent to, <br />or extend beyond the proposed subdivision in lieu thereof, or it may <br />require some combination of fee payment and facility construction. <br />The decision to require off-site construction in lieu of payment <br />shall be based on the construction practicability, the need for the <br />facility, and the ability of the city (or county) to share in the <br />cost of construction as required. The cost of constructing off-site <br />drainage facilities shall be shared by the owner/developer and the <br />city (or county) in accordance with Section 21.05.02(c). <br />(3) Location: All on-site and off-site drainage facilities shall be <br />located in street right-of-way where feasible, or in perpetual unob- <br />structed easements of appropriate width. The city (or county) shall <br />cooperate with and assist owners/developers subject to the provisions <br />of this ordinance in such matters as the exercise of its power of <br />eminent domain for obtaining easement rights for drainage facilities. <br />(b) Procedures: <br />(1) Plans and Specifications: Prior to final approval of a subdiv- <br />ision plat, detailed plans and specifications for the construction <br />and installation of the on-site and off-site drainage facilities as <br />required under this Section 21.05 shall be prepared in accordance <br />
