In every program funded under the Federal Civil Defense Act, statements of work <br />must specifically provide for measures and project results for nuclear attack <br />preparedness as defined in 3. below. For the sake of clarity, consistency, <br />and legal efficacy, the following definitions apply whenever the terms are <br />used in the statements of work or elsewhere in the Comprehensive Cooperative <br />Agreement. <br /> <br />1. The term ATTACK means any attack or series of attacks by an enemy of the <br />United States causing, or which may cause, substantial damage or injury <br />to civilian property or persons in the United States in any manner by <br />sabotage or by use of bombs, shellfire, or atomic radiological, chemical, <br />bacteriological, or biological means or other weapons or processes. <br />Consideration of the manner of such ATTACK shall not exclude a strategic <br />and/or tactical nuclear strike on the United States. <br /> <br />2. The term NUCLEAR ATTACK means a strategic nuclear war strike by.a hostile <br />government or enemy party directed at mu1ltiple targets within the geographical <br />boundaries of the United States. <br /> <br />3. The term NUCLEAR ATTACK PREPAREDNESS means activities undertaken' to <br />prepare for the protection of citizens in the event of a strategic nuclear <br />attack upon the United States. The purpose of such preparedness is to <br />enhance the survivability of the American people and its leadership in <br />the event of a nuclear attack, thereby improving the basis for eventual <br />recovery and reducing the nation's vulnerability to a major attack. <br /> <br />4. The term CIVIL DEFENSE SUPPORTED RESOURCES means all persons, equipment, <br />facilities, training, and other activities supported in whole or in part <br />by civil defense funds. <br /> <br />5. The term DUAL USE OF CIVIL DEFENSE is applied in the context of encouraging <br />the use or adaptation for use of nuclear attack planning, response and <br />necessary capabilities and resources in all natural, technological, and <br />attack-related emergencies. The term DUAL USE OF CIVIL DEFENSE SUPPORTED <br />RESOURCES means that there is a primacy of resource use to accomplish <br />nuclear attack preparedness objectives, while acknowledging that the <br />Objectives accomplished may be of benefit in preparing for and responding <br />to major life threatening natural' and technological disasters. Direct <br />use of one program's resources by another is not the intent of Congress. <br />If, however, there are civil defense supported resources available after <br />accomplishment of nuclear attack preparedness Objectives, they may be <br />applied to peacetime disaster preparedness Objectives provided that such <br />use is consistent with, contributes to, and does not detract from nuclear <br />attack preparedness. <br /> <br />C. The following definition applies whenever the term DUAL USE is used in <br />the context of multiple major life threatening disasters, both attack in <br />wartime and natural and technological emergencies in peacetime. The term <br />DUAL USE means that, while the primary use of resources is to accomplish the <br />Objectives of the program supported by them, work accomplished can be of <br />benefit to other programs. <br /> <br />I <br />
