<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />..,..,.... <br /> <br />AA-1 <br /> <br />FISCAL YEAR 1989 COMPREHENSIVE COOPERATIVE AGREEMENT <br />AGREEMENT ARTICLES <br /> <br />These articles, along with all relevant portions of the Standard Assurances <br />(Part V of the Application), are a binding part of the Agreement and are uniform <br />for all States. They are compatible with Federal Emergency Management Agency <br />(FEMA) and other applicable Federal statutes, regulations, and guidance and <br />adapt these requirements to the Comprehensive Cooperative Agreement. <br /> <br />Article I. Purpose <br /> <br />A. The purposes of this Agreement are: (1) to assist in consolidating a <br />statewide Integrated Emergency Management System dealing with emergencies <br />ranging from those caused by natural and technological hazards to conventional <br />war and nuclear attack, with emphasis on developing capabilities to save lives <br />and protect property; (2) to facilitate the delivery and use of authorized and <br />appropriated FEMA financial and technical assistance to State and local govern- <br />ments; and (3) to enable the State to exercise management discretion in achieving <br />the specified and agreed upon Objectives. <br /> <br />B. This Agreement provide~ a funding, operating, and reporting instrument for <br />the accomplishment of agreed-upon activities and products under the included <br />program activities or funding sources. The Agreement also allows the State <br />discretion to make use of the program resources in the accomplishment of agreed <br />upon objectives and some flexibility in the distribution of resources under <br />the Agreement, within the limits of Federal law and accountability requirements. <br />The Agreement, in particular, requires that the emergency management programs <br />apply to preparedness for strategic enemy attack as well as to natural and <br />technological disaster, and that other disaster preparedness and mitigation <br />measures can contribute to nuclear attack preparedness and vice versa. <br />The term "attack," as defined in II. B. below, covers the following means: <br />sabotage or by use of bombs, shellfire, or atomic radiological, chemical, <br />bacteriological, or biological means or other weapons or processes, including <br />a strategic and/or tactical nuclear strike on the United States. <br /> <br />.. <br />Article II. Scope of Work <br /> <br />A. Objectives to be accomplished and project results to be produced by the <br />State or recipient are specified in each program statement of work as agreed <br />to in legal obligation by the Signatory Officials on the Assistance Award/ <br />Amendment, FEMA Form 76-10. Local governments, likewise, must be legally <br />bound by agreements with the State for the performance of Objectives for which <br />they receive funds through the State from FEMA under this Agreement. Statements <br />of work must clearly describe objectives, their expected end products, and <br />milestones to be met. The statements of work were developed from requirements <br />set forth in the Annual Program Requirements Annexes. <br /> <br />..... ~" <br />
