Hold and save the United States free from claims for <br /> <br /> <br />damages which may result from construction and subsequent mainte- <br /> <br /> <br />nance of these two drainage channel improvements, except damages <br /> <br />due to the fault or negligence of the United States or its <br /> <br /> <br />contractors; <br /> <br />c. Assume responsibility for the design, construction, opera- <br /> <br /> <br />tion, and maintenance of the proposed lO-year channel improvement <br /> <br /> <br />and drainage improvements downstream from Kelly Road Dam to <br /> <br /> <br />Stapleton International Airport, and hold and save the United <br /> <br /> <br />States free from claims for damages which may result from <br /> <br /> <br />construction and subsequent maintenance of these improvements; <br /> <br />d. Prescribe and enforce regulations to prevent obstruction <br /> <br /> <br />or encroachment on the channel downstream from Kelly Road Dam <br /> <br /> <br />that would reduce its flood-carrying capacity or hinder operation <br /> <br /> <br />and maintenance; <br /> <br />e. Prescribe and enforce flood plain regulations which would <br /> <br /> <br />minimize future flood damages in the area downstream from Kelly <br /> <br /> <br />Road D&Ill that would be inundated from a flood with an annual <br /> <br /> <br />exceedance frequency of 1 percent; <br /> <br />f. Develop and implement an emergency flood warning and <br /> <br /> <br />evacuation plan for the area downstream from Kelly Road Dam in <br /> <br /> <br />recognition of the residual flood risk. The plan shall be <br /> <br /> <br />reviewed annually, modified if necessary, and the downstream <br /> <br /> <br />residents and other affected interests shall be informed, at <br /> <br /> <br />least annually, of the limitations of the protection afforded and <br /> <br /> <br />the residual flood risk; <br /> <br />. <br /> <br />78 <br />
