<br />. <br /> <br />development of damageable facilities on the flood plain than it <br /> <br /> <br />would be to spend large sums to protect those facilities, provide <br /> <br /> <br />disaster assistance, or indemnify flood losses with flood insur- <br /> <br /> <br />ance. Where development is sparse and potential damages to <br /> <br /> <br />existing facilities are low, structural measures generally can <br /> <br /> <br />not be economically justified; therefore, regulation can be <br /> <br /> <br />effective in slowing the growth in future damages and is a viable <br /> <br /> <br />alternative to structural measures to prevent flooding. Where <br /> <br /> <br />potential damages are high because of dense development, <br /> <br /> <br />regulation would not reduce damages to existing development but <br /> <br /> <br />it could reduce the rate of increase in future damages. In this <br /> <br /> <br />case, it could be used to complement structural measures by <br /> <br /> <br />retarding the growth of the residual damages which would occur <br /> <br /> <br />even with the structural measures installed. <br /> <br />Federal policy places the responsibility for implementation <br /> <br /> <br />and enforcement of flood plain regulation at the local level, but <br /> <br /> <br />it imposes certain requirements ia return for local eligibility <br /> <br /> <br />for flood insurance, Federal disaster assistance, and federally <br /> <br /> <br />insured loans. Failure by local communities to comply wi th the <br /> <br /> <br />requirements could lead to revocation of their eligibility. The <br /> <br />State of Colorado has followed the Federal lead with State flood <br /> <br /> <br />plain regulation legislation which also places the responsibility <br /> <br /> <br />for implementation and enforcement at the local level. In flood <br /> <br /> <br />hazard areas where there are no local regulations, the State can <br /> <br /> <br />impose a 90-day moratorium on proposed development. The Urban <br /> <br />Drainage and Flood Control District also has the authority to <br /> <br /> <br />implement flood plain regulations in the absence of action at the <br /> <br />local level. <br /> <br />24 <br /> <br />. <br />
