WHEREAS. the approximat~ 100-year floodplain information
for Fountain Creek upstream of a point approximately 3400 feet
upstream of Colorado Highway 47 bridge has been prepared. in a
manner consistent with the floodplain data and information
contained in the aforesaid report previously designated by
Resolution No.3; and

WHEREAS, the approximat~ 100-year floodplain information
for Dry Creek (East) has be~n prepared in a manner consistent
with the floodplain data 4nd information contained in the
aforesaid report previously designated by Resolution No.5; and

WHEREAS, the City of PUeblo has requested
Water Conservation Board to designate and
floodplain areas as set forth in the aforesaid new

WHEREAS, Section 37-60-i06(1), Colorado Revised Statutes
requires the Colorado Water ~onservation Board to assist in the
prevention of floods and damages therefrom; and

WHEREAS, Sections 31-23-301 and 30-28-111. Colorado Revised
Statutes. provide that sUch legislative bodies of local
jurisdictions may provide zOning regulations for land uses on
or along any storm or flood.,ater runoff channel or basin only
after designation and approval by the COlorado Water
Conservation Board; and

WHEREAS. Section 37-60-l06(1)(C). Colorado Revised
Statutes, directs the Colorado Water Conservation Board to
designate and approve storm or floodwater runoff channels or
basins and to make such designations available to legislative
bodies Of local jurisdictions; and

WHEREAS, the staff of tlle Board has reviewed. said revised
information and data and does hereby recommend to the Colorado
Water Conservation BoardthClt the Board designate and approve
as floodplain areas those ateas inundated by a 100-year flood
(intermad iate regional flood.) as described by the f loodwa ter
surface elevations and profiles in said FEMA report for the
reach of the Arkansas River from the downstream corporate limit
upstream to a point approxilllately 1500 ,feet downstream of the
Colorado Highway 96 bridge. the reach of Fountain Creek from
its confluence with the Arkansas River upstream to a point
approximately 3400 feet Upstream of the Colorado Highway 47
