WHEREAS, said report included detailed floodplain information for those portions of the Rito
Seco within the corporate limits of the Town of San Luis, as they were in December 1988; and

WHEREAS, the Colorado Water Conservation Board, as requested by the Town of San Luis,
by Resolution No. 94-369, adopted on July 19, 1994, approved and designated the floodplains described
in said report; and

WHEREAS, the detailed floodplain infonnation contained in Resolution No. 94-369 is consistent
with the approximate floodplain information contained in Resolution No. 299, for those portions ofRito
Seco within the corporate limits of the Town of San Luis, as they were in December 1988, only; and

WHEREAS, the detailed floodplain infonnation contained in Resolution No. 94-369 is consistent
with the approximate floodplain information contained in Resolution No. 94-366; and

WHEREAS, new approximate floodplain maps entitled "Flood Insurance Rate Maps, Costilla
County, Colorado, Unincorporated Areas", dated July 16, 1991, were prepared by the Federal
Emergency Management Agency; and

WHEREAS, said new maps contain approximate floodplain information for the following
streams, within the unincorporated portions of Costilla County only:

Rio Grande,
Trinchera Creek,
Sangre de Cristo Creek,
Ute Creek,
Culebra Creek,
Ventero Creek,
Rito Seco,
East Basin Rito Seco,
North Basin Rito Seco,
Costilla Creek, and
selected tributary streams;

and

WHEREAS, said new maps were prepared directly from the approximate floodplain information
contained in Resolution No. 299 and are therefore consistent with Resolution No. 299; and

WHEREAS, said new maps for the unincorporated portions of Costilla County are consistent
with Resolutions Nos. 94-366 and 94-369 for the Town of San Luis; and

WHEREAS, the Board of Commissioners of Costilla County, Colorado, has requested the
Colorado Water Conservation Board to designate and approve the floodplains set forth on the aforesaid
new maps; and

WHEREAS, the Board of Commissioners of Costilla County, Colorado, has not requested the
Colorado Water Conservation Board to rescind <lIlY portion of Resolution No. 299; and

WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado watere
Conservation Board to assist in the prevention of floods and flood damages therefrom; and
