<br />e <br /> <br />e <br /> <br />e <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-I06(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to make <br />such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information on said maps meets all of the requirements for approximate <br />information listed under the Board's "Rules and Regulations for the Designation and Approval of <br />Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the staff finds that there is no need to rescind any portion of Resolution No, 299 <br />in order to designate said new maps; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board in regular <br />meeting assembled in Denver, Colorado, this 13th day of March, 1995, that it does hereby designate and <br />approve as approximate floodplain information the 100-year floodplains as described on said maps, dated <br />July 16, 1991; and <br /> <br />BE IT FURTHER RESOLVED that the Board does not rescind any portion of Resolution No. <br />299, adopted on November 14, 1989, and that it does hereby leave that resolution fully in effect; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is directed to send a certified <br />copy of this resolution to the Board of County Commissioners of Costilla County; the Town of San <br />Luis; the Colorado Office of Emergency Managemel1t; and the Federal Emergency Management Agency. <br /> <br />CERTIfICATE <br /> <br />I certify that the foregoing is a true and correct copy of a resolution adopted by a majority vote <br />of the members of the Colorado Water Conservation Board in regular session assembled at Denver, <br />Colorado, on the 13th day of March, 1995, at which a quorum was present. <br /> <br />c~~{=A <br /> <br />Daries C.
