01 authority, and the appropriate federal agencies have approved
02 a mutually acceptable plan for state participation in the
03 Animas-La Plata participating project of the Colorado river
04 storage proj ect, such plan and the terms thereof shall be
05 presented to the general assembly for its consideration.
06 (5) At such time as the Colorado water resources and
07 power development authority and the appropriate local and
08 federal authorities have approved a mutually acceptable plan
09 for state participation in the Narrows project and at such
10 time as the said authority, in cooperation. wi th the proj ect
11 sponsors, has approved a mutually acceptable plan for state
12 participation in the project described in section 37-96-103
13 (1) (c), suc.h plan or plans and the terms thereof shall be
14 presented to the general assembly for its consideration.
15 SECTION 2. 29-2-108 (1) and (3), Colorado Revised
16 Statutes, 1977 Repl. Vol., as amended, are amended to read:
17 29-2-108. Limitation on amount. (1) In no case shall
18 the total sales tax or total use tax imposed by the state of
19 Colorado, any county, and any city or town in any locality in
20 the state of Colorado exceed seven AND FOUR-TENTHS percent;
21 except that this limitation shall not preclude a county sales
22 tax or use tax at a rate not to exceed one percent.
23 (3) The additional one-tenth of one percent tax imposed
24 by article 26.1 of title 39; C.R.S., shall be exempt from the
25 seven AND FOUR-TENTHS percent limitation imposed by subsection
26 (1) of this section and from the seven and one-half percent
27 limitation imposed by subsection (2) of this section.
