<br />01 39-26-123.2, C.R.S., shall be transferred.to the wildlife cash <br />02 fund created in section 33-1-112 (1), C.R.S., for use by -the <br />03 division of wildlife in the department of natural resources <br />04 for the sole purpose of mitigating losses of wildlife and <br />05 aquatic habitat and of mitigating other adverse environmental <br />06 impacts occasioned by the future construction, operation, and <br />07 use or by the future repair, rehabilitation, and enlargement <br />08 of nonfederal water projects. <br />09 (b) It is the purpose and intent of paragraph (a) of this <br />10 subsection (2) that the mitigation of such losses and impacts <br />11 shall be the singular responsibility of the state of Colorado <br />12 and shall be carried out solely with the moneys provided to <br />13 the division of wildlife pursuant to paragraph (al of this <br />14 subsection (2). The costs of such mitigation shall be <br />15 nonreimbursable. <br />16 (cl No mitigation of environmental .impacts other than <br />17 those whose costs are within the amounts available pursuant to <br />18 paragraph (a) of this subsection (2) shall be demanded or <br />19 recommended, either directly or indirectly, by any agency of <br />20 Colorado state government. <br />21 (3) Eighty percent of the moneys credited to the fund, <br />22 tqgether with interest accruing from the investment thereof, <br />23 shall be available for appropriation by the general assembly <br />24 for funding, in whole or in cart, and in cooperation with <br />25 federal, state, or local agencies and entities: <br />26 (a) Planning studies, including environmental <br />27 assessments and environmental impact statements, for Colorado <br />28 water projects, the costs of which assessments and statements <br />29 shall be nonreimbursable: <br /> <br />-3- <br />
