<br />01 37-96-102. Purposes of the fund. (1) In order that the <br />02 people of the state of Colorado may, as a matter of statewide <br />03 concern, have and enjoy the perpetual use of those waters <br />04 apportioned to the state of Colorado by interstate compact <br />05 and in order to dispose of any current or future cl aims, <br />06 demands, or req.uirements for compensation, compensatory <br />07 storage, damages, or mitigation of damages originating within <br />OB the basin of origin because of present or future transbasin <br />09 diversions, notwithstanding any provision of section 37-45-11B <br />10 (1)(b)(IV),. or of article 65.1 of title 24,. C.R.S., or of <br />11 article 2B of title 30, C.R.S., or of any other law to the <br />12 contrary with respect to such claims, demands, or <br />13 requirements, fifteen percent of the annual revenues credited <br />14 to the fund pursuant to section 39-26-123.2, C.R.S., together <br />15 with the interest accruing from the investment thereof, shall <br />16 be used to plan and construct reservoirs and related <br />17 facilities in western Colorado with a collective available <br />1 B capaci ty of not less than three hundred thousand acre-feet, <br />19 excluding the available capacity of the Animas-La Plata <br />20 participating project of the Colorado river storage project, <br />21 of which amount not less than two hundred twenty-five thousand <br />22 acre-feet shall be available exclusively for future uses in <br />23 western Colorado and not less than seventy-five thousand <br />24 acre-feet shall be available to make exchanges or compact <br />25 deliveries requir-ed to accommodate diversions from the <br />26 Colorado river basin for uses outside the basin within the <br />27 state of Colorado. <br />2B (2) (a) At the end of each fiscal year, five percent of <br />29 the annual revenues credited to the fund pursuant to section <br /> <br />-2- . <br />
