Title 37, Colorado Revised Statutes, as <br />06 amended, is amended BY THE ADDITION OF A NEW ARTICLE to read: <br />07 ARTICLE 96 <br />08 Colorado Water Resources Development Fund <br />09 37-96-101. Colorado water resources development fund - <br />10 creation. (1) There is hereby created a fund, to be known as <br />11 the Colorado water resources development fund and referred to <br />12 in this article as the "fund", which shall consist of all <br />13 moneys credited thereto pursuant to section 39-26-123.2(1), <br />14 C.R.S., and of all moneys which may be otherwise made available <br />15 to it by the general assembly. All interest earned from the <br />16 investment of moneys in the fund shall be credited to the fund <br />17 and shall become a part thereof. The fund shall be a <br />18 continuing fund, and the moneys in the fund shall not revert to <br />19 the general fund of the state at the end of any fhcal year. <br />20 The moneys in the fund shall be expended for the purposes and <br />21 in the manner set forth in section 37-96-102 and in accordance <br />22 with the priorities specified in section 37-96-103. <br />23 (2) FOllowing the close of any fiscal year in which the <br />24 moneys in the fund exceed three hundred million dollars, after <br />25 the transfer of moneys required by section 37-96-102 (2)(a) and <br />26 excluding any amount held in the fund pursuant to section <br />27 37-96-102 (1), such excess shall be credited to the capital <br />28 construction fund created in section 24-75-302, C.R.S. <br />29 <br /> <br />ed <br />(re/drt) <br />
