<br />. <br /> <br />Rule 18. Exemot Structures: <br /> <br />18.A. Existing or proposed structures not designed Dr operated <br />for the purpose of impounding water are exempt from these rules and <br />regulations. Exempt structures include: <br /> <br />18.A.(1) Highways, roadfills, and railroad embankments, <br />(except those designed or modified with the purpose or effect of <br />impounding water for uses other than flood detention); and, <br /> <br />18.A.(2) Diversion dams if less than jurisdictional size, <br />and all diversion dams of any size if Class III or IV. <br /> <br />18.A.(3) Refuse embankments; (e.g., solid waste disposal <br />facilities) , <br /> <br />18.B. Mill tailing impoundments which are permitted under the <br />Colorado Mined Reclamation Act, Sections 34-32-101 through 125, C.R.S. <br />(1973)(1987 Supp.)(Minerals), or the Colorado Surface Coal Mining <br />Reclamation Act, Sections 34-33-101 through 137, C.R.S. (1973)(1987 <br />Supp.) (Coal) are exempt from these rules and regulations. <br /> <br />18.B.(1) Any solution process impoundment permitted under <br />the Colorado Mined Reclamation Act, or the Colorado Surface Coal <br />Mining Reclamation Act, are exempt from these regulations. <br /> <br />18.C. Uranium mill tailing and liquid impoundment dams, <br />permitted under the Colorado Department of Health are exempt from <br />these rules and regulations. Raw and potable water dams, sewage <br />effluent dams, and water treatment sludge dams associated with the <br />uranium mill are not exempt. <br /> <br />18.D. Siltation structures which are permitted under the <br />Colorado Surface Coal Mining Reclamation Act, Sections 34-33-101 <br />through 137, C.R.S. (1973)(1987 Supp.)(Coal), are exempt from these <br />rules and regulations. <br /> <br />18.E, Structures which store water only below the lowest point <br />of the natural ground are exempt from these rules and regulations <br />unless an outlet works is constructed to develop water, <br /> <br />18.F. Livestock Water Tanks as defined in the Livestock Water <br />Tank Act of Colorado, Sections 35-49-101 through 116, C.R.S. (1973), <br />are exempt from these rules and regulations. <br /> <br />18.G. Erosion Control Dams as defined in Section 37-87-122, <br />C.R.S. (1973), are exempt from these rules and regulations. <br /> <br />- 47 - <br />
