<br />Rule 19. Restriction of Recreational Facilities Within Reservoirs: <br /> <br />19.A. No person, including any state or federal agency, <br />quasi-municipal corporation, or political subdivision, shall construct <br />any permanent recreational structure within a reservoir below the <br />elevation of the bottom of the spillway unless: <br /> <br />1. The facility is constructed to withstand partial or <br />complete inundation without significant damage; or <br />2. The facility is necessary to the operation of the <br />reservoir; and <br />3. The facility is capable of being restored with a minimum <br />amount of cleaning or expense. Boatramps, docks, and <br />marinas are exempt from these rules. <br /> <br />19.B. This rule does not apply to facilities completed prior to <br />July 1, 1984, but shall apply to any enlargements or modifying of such <br />facilities. <br /> <br />19.C. Any person planning on constructing, enlarging, or <br />modifying any facility coming under this rule shall notify the State <br />Engineer in writing 180 days in advance of construction. They shall <br />include the following information: <br /> <br />1. The name and location of the reservoir and/or dam; <br /> <br />2. Whether the recreational facility is new, or an enlargement <br />or modifying of a facility completed prior to July 1, 1984; <br /> <br />3. <br /> <br />A description of the facility, its intended purpose, <br />location within the reservoir including depth below <br />water line; and <br /> <br />and its <br />the high <br /> <br />4. A description of how the facility will be able to withstand <br />the damage from the inundation without a significant amount <br />of cleaning or expense to restore it. <br /> <br />19.0, <br />mod i fy any <br />Engineer, <br /> <br />No person shall be allowed to construct, enlarge, or <br />facility coming under this rule until approved by the State <br /> <br />- 48 - <br />
