<br />Rule 9.0. For Minor, Class III dams and all Class IV dams, the <br />owner shall provide an engineer experienced in dam design and con- <br />struction who shall be responsible for the following: <br /> <br />9.0.(1) Notify the State Engineer of the start of construction; <br /> <br />9.0.(2) The engineer shall provide for the observation of the <br />construction and endeavor to guard against defects and deficiencies in <br />the construction of the dam and shall disapprove or reject work <br />failing to conform to the approved plans and specifications; <br /> <br /> 9.0, (3) Change orders sha 11 be submitted in accordance with <br />Rule 9.A. (8); <br /> 9.0,(4) The engineer sha 11 give the State Engineer at least 10 <br />days advance notice of their final construction inspection; and <br /> <br />9.0.(5) The engineer shall notify the State Engineer of the <br />completion of the construction in accordance with Rule 10. <br /> <br />Rule 10. Acceotance of Construction. Enlaraement. Alteration. <br />Modification or Reoair (Jurisdictional Dams): <br /> <br />10.A. Construction for which application has been made pursuant to <br />Rule 5 shall not be deemed complete nor shall storage of water be <br />permitted until the State Engineer furnishes to the owner a written <br />statement of acceptance, unless temporary approval of storage is <br />granted by the State Engineer. The acceptance shall specify the <br />vertical height, freeboard, length of the dam, the capacity of the <br />reservoir in acre-feet, and any limitation upon, or requirements for <br />the use of the dam. The State Engineer shall furnish the acceptance <br />or denial within 60 days of receipt of a complete notification of <br />completion. <br /> <br />10.B. The engineer shall provide written notification of completion <br />which shall include the following in order to be deemed complete: <br /> <br />10.B.(1) A written notification that the project is complete and <br />in general conforms with the approved plans, specifications and change <br />orders. <br /> <br />10.B.(2) The As-Constructed Plans which meet the requirements of <br />Rul e 5. <br /> <br />- 35 - <br />
