<br />7.A.(2)(a) The dam shall be excavated down to the level <br />of the natural ground, or as necessary in accordance with Rule <br />7.A.(2)(c), at the maximum section; and the breach shall be of <br />sufficient width to pass the"100-year.24-hour flood at a depth of less <br />than five feet, However, the maximum breach width shall be the total <br />removal of the dam regardless of the flood magnitude; <br /> <br />7.A.(2)(b) <br />to a slope which is stable <br />vertical; <br /> <br />The sides of the breach shall be excavated <br />but not steeper than one horizontal to one <br /> <br />7.A.(2)(c) The breach shall be designed to control <br />silt, which has previously been deposited on the reservoir bottom and <br />the excavated material from the breach from washing downstream; <br /> <br />7.A.(2)(d) <br />trolled manner which will <br />properties; and <br /> <br />The <br />not <br /> <br />reservoir shall <br />endanger lives <br /> <br />be emptied in a con- <br />or damage downstream <br /> <br />7.A.(2)(e) The drawing(s) of the plan for the breach of <br />a dam shall include the location, dimensions and lowest elevation of <br />the breach. <br /> <br />7.A.(3) For Class III and Class IV dams the owner shall <br />submit a written notice of intent to breach the dam to the State <br />Engineer. <br /> <br />7.A.(3)(a) The State Engineer shall determine the size <br />of the breach in accordance with the following: The bottom width of <br />the breach shall be one-half the height of the dam but not less than <br />ten feet; and the side slopes not steeper than one horizontal to one <br />vertical. The breach shall be to original ground at the low point in <br />the foundation of the dam and the excavated material shall not be <br />placed in the stream channel. <br /> <br />Rule 8. Aooroval for Construction. Enlaroement. Alteration. <br />Modification. or Reoair Becomes Void After Five Years. <br /> <br />If construction, alteration, or repair of a reservoir dam is not <br />commenced within five years of approval of the application, the State <br />Engineer's approval shall be void. The owner must resubmit the <br />application and receive approval before commencing construction, and <br />shall meet the requirements of the current rules and regulation. <br /> <br />- 30 - <br />
