<br />WHEREAS, the approximate floodplain delineations contained in said report with included <br />map for Lake Loveland are consistent with the floodplain delineations contained in Resolution Nos. <br />354.13 and 381 (Table I, Ref. Nos. 2 and 5); and <br /> <br />c.R.S AUTHORITY <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along <br />any storm or floodwater runoff channel or basin only after designation and approval by the <br />Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60cI06(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or basins <br />and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br />WHEREAS, said report with included map dated March 23, 1999 was revised from the <br />previous version (Table I, Ref. No.4) to incorporate the results of a Letter of Map Revision <br />(LOMR) issued on September 18, 1997, which showed the effects of more detailed topographic <br />information along the Big Thompson River from approximately 1,340 feet downstream of West <br />First Street to approximately 710 feet downstream of Wilson A venue; and <br /> <br />WHEREAS, the detailed hydrology information for the Big Thompson River in said report <br />dated March 23, 1999 is consistent with the requirements for detailed hydrology information listed <br />under the Board's "Rules and Regulations for the Designation and Approval of Floodplains and of <br />Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the corporate limits of the City of Loveland are not accurately reflected in said <br />report with included map dated March 23, 1999 due to annexations that occurred following the <br />initiation of said report; and <br /> <br />WHEREAS, the adjacent Flood Insurance Study and Flood Insurance Rate Maps for <br />unincorporated portions of Larimer County contained in proposed Resolution No. 491 (Table I, <br />Ref. No.7) depict floodplain delineations for the Big Thompson River that are now within the <br />corporate limits of the City of Loveland that should be utilized by the City of Loveland for <br />floodplain management activities within the current corporate limits; and <br /> <br />WHEREAS, the water surface profiles in said report dated March 23, 1999 in the City of <br />Loveland are not consistent with the requirements for detailed information listed under the Board's <br />"Rules and Regulations for the Designation and Approval of Floodplains and of Storm or <br /> <br />3 <br />
