<br />WHEREAS, the new revised Flood Insurance Study for <br />Unincorporated Larimer County, dated March 18, 1986, is hereby <br />considered to be part of the new revised Flood Insurance Study <br />for Unincorporated Larimer County, dated March 4, 1987; and <br /> <br />WHEREAS, the Board of County Commissioners of Larimer <br />County has requested the Colorado Water Conservation Board to <br />designate and approve the floodplain areas as set forth in the <br />aforesaid new report; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado .Revised <br />Statutes, requires the Colorado Water Conservation Board to <br />assist in the prevention of floods and flood damages.therefrom; <br />and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised <br />Statutes, provide that such legislative bodies of local <br />jurisdictions may provide zoning regUlations for land uses on <br />or along any storm or floodwater runoff channel or basin only <br />after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised <br />Statutes, directs the Colorado Water Conservation Board to <br />designate and. approve storm or floodwater runoff channels or <br />basins and to make such designations available to legislative <br />bodies of local jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed said revised <br />information and data and does hereby recommend to the Colorado <br />Water Conservation Board that the Board designate and approve <br />as floodplain areas those areas inundated by a 100-year flood <br />(intermed iate regiona 1 flood) as described by the floodwa ter <br />surface elevations and profilesn'in sai'dnew report, and furth'er <br />recommends that the portions of the floodplain desiqnation for <br />Dry Creek from its confluence with the Cache la Poudre River <br />upstream to the 1978 eastern corporate limit of the ci ty of <br />Fort Collins, Dry Creek from the 1978 northern corporate limit <br />of the City of Fort Collins to a point approximately 500 feet <br />downstream of Shields Street, Boxelder Creek from its <br />confluence with the Cache la Poudre River upstream to a point <br />approximately 100 feet upstream of willox Lane, the Fall River <br />from the 1978 western corporate limit of the City of Estes Park <br />upstream to the eastern boundary of Rocky Mountain National <br />Park, the Big Thompson River from Lake F;stes upstream to the <br />1978 eastern corporate limit of the City of Estes Park, and the <br />Big Thompson River from the 1978 southwestern corporate limit <br />of the City of Estes Park upstream to the eastern boundary of <br />Rocky Mountain National Park, as approved by Resolution No. <br />128, adopted January 31, 1979, be rescinded; <br /> <br />-3- <br />
