<br />3. OPEN SPACE RESERVATION <br />The DEVELOPER in conjunction with the development of Phases I and II agrees to <br />reserve for permanent open space, a total of 22 acres of land, designated as <br />Parcel E on the Master Plan to be used as.a park and open space. It is also <br />agreed that at a later date within the schedule of the P.U.D. as shown in Ex- <br />hibit B, the owner thereof may convey this ~arcel for use as a'public park in <br />conjunction with developments proposed by the Division of Wildlife in restock- <br />ing and rechannelizing the Swan River for recreational and fishing use. Such <br />conveyance'would be made available by the OWNER at a price not to exceed its <br />cost plus Teasonable cinterest during-the periodocoLownership.:and cost of im- <br />proverrents .thatbenefit the parcel. directly-subject-to~approval-and acceptance <br />by the County. <br />4. SEWER TAPS <br />It is understood by the DEVELOPER, and their successors and assigns, that taps <br />for sewer service will be made available during-the__projected years .of construc- <br />tion ona.first-come - ftrst-served basis as made~v.ai1able by_the Breckenridge <br />Sanitation Distri~t. ~dditional development beyond the Phase I development as <br />outlined in_Exhibit B, sball:be'subjectto.the-availability of sewercservice. <br />5.
