<br />WHEREAS, said new report describes and outlines the
<br />detailed floodplain information for the storm and floodwater
<br />runoff channels or basins for East Plum Creek, Hangmans Gulch,
<br />Sellers Gulch, unnamed tributary to Sellers Gulch, and Cherry
<br />Creek within the study area; and
<br />
<br />WHEREAS, said new report includes floodprone areas (Zone
<br />A), which are approximate floodplains, for 6400 Tributary West
<br />Fork, 6400 Tributary East Fork, 6400 South Tributary, Tributary
<br />B to East Plum Creek, Tributary D to East Plum Creek, Tributary
<br />C to Tributary D, unnamed tributary to East Plum Creek, McMurdo
<br />Gulch, unnamed tributary to McMurdo Gulch, Mitchell Gulch, and
<br />unnamed tributary to Mitchell Gulch; and
<br />
<br />WHEREAS, the Town of Castle Rock has requested the Colorado
<br />Water Conservation Board to designate and approve the
<br />floodplain areas as set forth in the aforesaid new report; and
<br />
<br />WHEREAS, Section
<br />Statutes, requires the
<br />assist in the prevention
<br />and
<br />
<br />37-60-106(1)(c), Colorado Revised
<br />Colorado Water Conservation Board to
<br />of floods and flood damages therefrom;
<br />
<br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised
<br />Statutes, provide that such legislative bodies of local
<br />jurisdictIons may provide zoning regulations for land uses on
<br />or along any storm or floodwater runoff channel or basin only
<br />after designation and approval by the Colorado Water
<br />Conservation Board; and
<br />
<br />WfIEREAS, Section 37-60-106(1)(c), Colorado Revised
<br />Statutes, directs the Colorado Water Conservation Board to
<br />designate and approve storm or floodwater runoff channels or
<br />basins and to make such designations available to legislative
<br />bodies of local jurisdictions; and
<br />
<br />WHEREAS, the staff of the Board has reviewed said revised
<br />detailed and approximate floodplain information and does hereby
<br />recommend to the Colorado Water Conservation Board that the
<br />Board designate and approve as floodplain areas those areas
<br />inundated by a lOO:;'year - flood (intermediate regional flood) as
<br />described by the floodwater surface elevations and profiles and
<br />by the floodprone area delineations (Zone A) in said new
<br />report, and further recommends that the floodplain designation
<br />for East Plum Creek, Sellers Gulch, unnamed tributary to
<br />Sellers Gulch, and Hangmans Gulch, as approved by Resolution
<br />No. 113, adopted November I, 1978, and the floodplai~
<br />designation for East Plum Creek, Hangmans Gulch, Cherry Creek,
<br />Sellers Gulch, unnamed tributary to Sellers Gulch, 6400
<br />Tributary East Fork unnamed tributary to East Plum Creek, and
<br />McMurdo Gulch, within the 1987 corporate limits of the Town of
<br />Castle Rock, as approved by Resolution No. 164, adopted
<br />September 9, 1980, be rescinded;
