C.R.S AUTHORITY WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any stonn or floodwater runoff channel or basin only after designation and approval by the Colorado Water Conservation Board; and WHEREAS, Section 37-60-106(I)(c), Colorado Revised Statutes, directs the Colorado Water Conservation Board to designate and approve stonn or floodwater runoff channels or basins and to make such designations available to legislative bodies of local jurisdictions; and COMPLIANCE WITH CWCB TECHNICAL STANDARDS WHEREAS, the detailed floodplain inforI1lation in said report, as listed in Table 3, for the unincorporated portions of Morgan County meets ail of the requirements for detailed information listed under the Board's "Rules and Regulations for the Designation and Approval of Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and WHEREAS, the approximate floodplain infonnation for the South Platte River contained in said report for the unincorporated portions of Morgan County is based on the information contained in Resolution No. 392, and therefore meets all of the requirements for approximate information listed under the Board's "Rules and Regulations for the Designation and Approval of Floodplains and ofStonn or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and WHEREAS, the hydrology infonnation for the remaining approximate floodplains for certain streams in said report with included Hydrology Addendum can be estimated in accordance with the CWCB's Guidelines for Determinirlg lOO-Year Flood Flows for Approximate Floodplains in Colorado (Guidelines); and WHEREAS, the IOO-year flow for certain stream reaches within Morgan County may be estimated by utilizing the regression equation within the South Platte River Basin Subregion SPL- I, as set forth in the Guidelines, providing that the stream's drainage area falls within the applicable range for the SPL-l regression equation, as set fortl1 in the Guidelines; and WHEREAS, the l00-year flow for approximate stream reaches within Morgan County which have drainage areas that are greater than 0.5 square mile and less than the applicable lower limit for the SPL- I regression equation, as set forth in the Guidelines, may be estimated by utilizing an applicablereg~ession equation within a U.S. Geological Survey (USGS) hydrology publication; and 4
