<br />AND WHEREAS, this regulation shall apply to all lands within <br />the jurisdiction of Fremont County, as may be shown on the Flood <br />Hazard Zone District Map. <br />(a) The boundaries of the designated flood hazard area, in- <br />cluding the floodway zone and the low hazard zone shall be deter- <br />mined and established by interpolations of the water levels on the <br />subject property as determined by the flood elevation bench marks <br />closest to the subject property. The applicant may submit his own <br />technical evidence to the Building Inspector, if he so desires; <br />(b) The degree of flood protection required by this regula- <br />tion is considered reasonable for regulatory purposes and is based <br />on application of hydrologic studies to establish the subject area. <br />Larger floods may occur on rare occasions or flood heights may be <br />increased by man-made or natural causes. This regulation does not <br />imply that areas not regulated as flood hazard areas hereunder will <br />be free from flooding or flood damages. This regulation shall not <br />create liability on the part of the County of Fremont or any officer <br />or employee thereof for any flood damages that result from reliance <br />on this regulation or any administrative decision lawfully made there- <br />under; <br />AND WHEREAS, the Planning Commission of Fremont County has con- <br />sidered and recommended the adoption and enactment of these regula- <br />tions by the Board of County Commissioners of Fremont County; <br />AND WHEREAS, a public hearing concerning the adoption of the <br />proposed regulations was held on the 10th day of November <br />1975 at the hour of 4:00 P.M, , pursuant to notic,e duly published <br />as required by 30-28-112, CRS 1973 as the statutes of the State of <br /> <br />-3- <br /> <br />
