<br />Comments on the Proposed Fremont County Floodplain Regulation <br /> <br />December 29, 1975 <br />Eugene J. Van Camp <br /> <br />1. The matter of permitting only such uses within the designated <br />floodplain and will not endanger life ... etc. (included in <br />purposes (a)), should read "as will not endager life ... etc. <br />Permitting such uses would include "allowing" such uses as a <br />permitted use, with provisions for "conditional" uses with such <br />allowed uses classified on the basis of their hazard. <br /> <br />The permission granted for a use is limited to the issuance of a <br />"construction" permit and a "building" permit without regard to <br />the regulatory objectives for zoning provisions and the manner <br />that (1) development processes for uses account for the "safety" <br />from flood hazards, and (2) technical data and information require- <br />ments for such processes as they apply to: <br /> <br />(a) A use that may be appropriately located in flood areas <br />such as the zoning of a use in specific areas subject to <br />flooding. <br /> <br />(b) Where specific uses subject to flooding may be allowed <br />in flood areas such as the subdivision controls of zoned areas. <br />Permitted uses should be based upon damage potential to life <br />and property. Permitted uses for the low hazard zone should be <br />specified. <br /> <br />2. The applicability of the regulation on page 3, (b) refers to the <br />degree of flood protection ..."based on application of hydrologic <br />studies to establish the subject areas." Since hydrologic and <br />hydraulic analysis are two distinctive part of floodplain deter- <br />minations (1) establishing the 100 year flood flow and (2) estab- <br />lishing the water surface elevations, it would be more appropriate <br />to say.,. "is based on technical findings of fact for flood data <br />and information approved to establish the subject area." <br /> <br />3. The requirements for technical data and information provided for <br />building permits, under Section 500, Enforcement (page 17) would <br />appropriately apply to a permit for "construction" (filling of <br />any site, or alteration of any drainageway). No provisions for <br />technical data requirements (as to location and extent) for flood <br />hazard areas, the uses of which may be subject to flooding. <br /> <br />4, Page 15, section 410. Principal permitted uses are not defined. <br />There should be a classification of permitted uses based upon <br />their hazard risk. See comment 1. The stipulations under "c. <br />general" are actually limitations of permitted uses and should <br />be so identified. <br />
