<br />Creek, Silver Gulch, and unnamed tributaries to Silver Gulch, within the incorporated portions of <br />Blackhawk, as they were on April 16, 1984; and <br /> <br />FLOODPLAIN CONSISTENCY <br /> <br />WHEREAS, the detailed floodplain delineations contained in said report are consistent with <br />the detailed floodplain delineations contained in Resolution No. 175 (Table 1, Ref. No.1); and <br /> <br />WHEREAS, the approximate floodplain delineations contained in said report are not <br />included in Resolution No. 175; and <br /> <br />LOCAL REOUEST FOR DESIGNATION ACTION <br /> <br />WHEREAS, the City of Blackhawk, Colorado has requested the Colorado Water <br />Conservation Board, by letter dated January 20, 1999 to designate and approve the detailed and <br />approximate floodplain delineations published in said report; and <br /> <br />WHEREAS, the City of Blackhawk, Colorado has also requested technical assistance in the <br />development of new floodplain information for their community; and <br /> <br />C.R.S AUTHORITY <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide wning regulations for land uses on or along <br />any storm or floodwater runoff channel or basin only ,after designation and approval by the <br />Colorado Water Conservation Board; and <br /> <br />STUDY ACCURACY <br /> <br />WHEREAS, the detailed and approximate floodplain delineations in said report reflected <br />the physical floodplain conditions within the City of Blackhawk as of April 16, 1984, and those <br />delineations were reasonably accurate at the time of the study; and <br /> <br />WHEREAS, significant physical changes to the detailed and approximate floodplains have <br />taken place within the City of Blackhawk, since the time of the study, as a result of rapid <br />development due to the legalization of limited stakes gambling within that community; and <br /> <br />WHEREAS, the detailed and approximate floodplain information contained in said report <br />does not reflect current topographic, hydraulic, and development conditions as they exist at this <br />time within the City of Blackhawk; and <br /> <br />2 <br />
