(b) When the Administrator has de- linea.ted Zone M on the community's FIRM. the community sha.lI; (I) Meet the requirements of para- gra.ph (a) of this section; and (2) Adopt a.nd enforce a. grading ordi- nance or regulation in accorda.nce with data supplied by the Administrator which (I) regulates the location of foundation systems and utility systems of new construction and substantial Improvements, (il) regulates the loca- tion, drainage and maintenance of all excavations. cuts a.nd fills and planted slopes. (ill) provides specia.l reqUire- ments for protective measures includ- Ing but not necessarily limited to re- taining walls. buttress fills. sub-drains, diverter terraces, benchings. etc., and (iv) requires engineering drawings and specifications to be submitted for a)) corrective meuures. a.ccompanied by supporting soils englneering and geol- ogy reports. If the Administrator has not provided suffi- cient data to furnish a. buls for these regula.tlons In a. partlcula.r community. the community sha.1l obtain. review. and reasona.bly utlllze data a.vallable from. other Federa.l, State or other sources, pending receipt of da.ta from the Administrator. However, when spe- cia.l flood-rela.ted erosion ha.za.rd &rea designa.tions have been furnished by the Administra.tor they sha.ll a.pply. The symbols defining such special flood-rela.ted erosion hazard designa.- tions a.re set forth In f 64.3 of this sub- chapter. In a.1I cases the minimum re- quirements governing the adequa.cy of the flood plain management regula.- tions for flood-related erosion-prone a.reas a.dopted by a pa.rtlcula.r commu- nity depend on the a.mount of technical data provided to the community by the Administrator. Minimum standards for communities a.re as follows; (a) When the Administra.tor has not yet identified any a.rea within the com- munity as having special flood-related erosion ha.za.rds. but the community hu Indicated the presence of such haz- a.rds by submitting a.n application to participate in the Program. the com- munity sha.ll (I) ReqUire the issuance of a permit for a.ll proposed construction, or other development In the area of flood-relat- ed erosion hazard, as it is known to the community; (2) Require review of each permit ap- plication to determine whether the proposed site alterations and improve- ments will be reasona.bly sa.fe from flood-related erosion a.nd will not ca.use 242
