The <br />buffer may be used for suitable open <br />spa.ce purposes. such as for a.grlcul- <br />tural, forestry, outdoor recreation a.nd <br />wildlife habitat a.reas, a.nd for other ac- <br />tivities using tempora.ry and portable <br />structures only. <br /> <br />[41 FR 46975, Oct. 26, 1976. The Administrator does not set <br />forth absolute criteria. for granting <br />variances from the criteria set forth In <br />If 60.3, 60.4, a.nd 60.5. The issua.nce of a. <br />va.rlance Is for flood plain ma.nagement <br />purposes only. Insurance premium <br />ra.tes are detennlned by statute accord- <br />ing to actua.rlal risk and will not be <br />modified by the gra.nting of a. variance. <br />The communi ty, a.fter exa.minlng the <br />applicant's ha.rdships, shall a.pprove or <br />disapprove a request. Whl1e the grant- <br />Ing of variances genera.l1Y is limited to <br />a. lot size less tha.n one-ha.lf a.cre (as set <br />forth in pa.ra.gra.ph (a.)(2) of this sec- <br />tion), deviations from that limitation <br />ma.y occur. However, as the lot size In- <br />creases beyond one-half a.cre, the tech- <br />nic&l Justification required for issuing <br />a varia.nce Increases. Var1a.nces may be issued <br />for the repa.lr or rehablll tatlon of his- <br />toric structures UPOIl a determlna.tlon <br />tha.t the proposed repa.lr or reha.blll ta- <br />tlon will not preClude the structure's <br />continued deslgna.tlon as a. historic <br />structure a.nd the var1a.nce Is the mini- <br />mum necessa.ry to preserve the historic <br />cha.ra.cter a.nd design of the structure. <br />Procedures for the gra.nting of <br />var1a.nces by a. community are as fol- <br />lows: <br />(1) Va.rlances sha.l1 not be Issued by a. <br />community within any designated reg- <br />ula.tory floodwa.y if any Increase In <br />flood levels durinr the base flood dis- <br />charge would resul\; <br />(2) Variances may be issued by a. <br />community for new construction and <br />substantial Improvements to be erected <br />on a lot of one-half a.cre or less In size <br />contiguous to and surrounded by lots <br />with existing structures constructed <br />below the base flood level. in confonn- <br />a.nce with the procedures of para.graphs <br />(a.) (3). (4). (5) a.nd (6) of this section; <br />(3) Variances sha.ll only be Issued by <br />a community upon (I) a. showing of <br />good and sufficient cause. (II) a. deter- <br />mina.tlon that fa.llure to gra.nt the var1- <br />ance would result in exceptional ha.rd- <br />ship to the appl1cant, a.nd (111) a. deter- <br />mination that the granting of a. va.ri- <br />ance wlll not result in Increased flood <br />heights, &ddltlonal threats to pUbl1c <br />safety, extra.ordina.ry pUbl1c expense, <br />crea.te nuisances, cause fraud on or vlc- <br />t1mlza.tion of the public, or conflict <br />with existing local laws or ordinances; <br />(4) Va.riances shall only be issued <br />upon a determination that the variance <br />is the minimum necessa.ry. considering <br />the flood ha.za.rd. to a.fford relief; <br />(5) A community shall notiry the ap- <br />pllca.nt In writing over the signature of <br />a. community officl&l tha.t (I) the Issu- <br />a.nce of a. va.ria.nce to construct a. struc- <br />ture below the base flood level w1ll re- <br />sult In increased premium rates for <br />flood Insura.nce up to amounts a.s high <br />as $25 for SlOO of Insura.nce covera.ge <br />and (II) such construction below the <br /> <br /> <br />243 <br />
