shall;
(1) Meet the requirements of para-
graphs (c) (1) through (l4) a.nd (d) (l)
through (4) of this section.
(2) Adopt the official map or legal de-
scription of those a.reas within Zones
AR, ARlAl-30, AR/AE, ARlAH, ARIA, or
ARlAO that are designated developed
a.reas as defined in 159.1 In accordance
with the eligibility procedures under
f 65.14.
(3) For a.11 new construction of struc-
tures in a.reas within Zone AR that a.re
designated as developed a.reu and in
other areu within Zone AR where the
AR flood depth Is five feet or less;
(i) Determine the lower of either the
AR base flood elevation or the ele-
vation tha.t is 3 feet above highest &dia-
cent grade; and
(il) Usinr this elevation, require the
sta.nda.rds of paragraphs (c) (1) through
(14).
(4) For all new construction of struc-
tures in those a.reas within Zone AR
that are not designated as developed
a.reas where the AR flood depth is
greater than 5 feet;
(I) Determine the AR base flood ele-
va.ti on; and
(ii) Using that elevation require the
standa.rds of paragraphs (c) (1) through
(14).
(5) For all new construction of struc-
tures In a.reas within Zone ARlAl-SO,
ARlAE, ARlAH, ARiAO. and ARiA:
(I) Determine the applicable ele-
vation for Zone AR from pa.ragraphs (3)
and (4);
(II) Determine the base flood ele-
vation or flood depth for the underly-
Ing AI-SO, AE, AH, AO and A Zone; and
(111) Using the higher eleva.tion from
(1) and (II) require the standa.rds of
paragraphs (c) (1) through (14).
(6) For all substantial improvements
to existing construction within Zones

for mudslide {i.e., mudllow)-prone
areas.

The Administra.tor will provide the
da.ta upon which flood pla.ln ma.nage-
ment regulations shall be based. If the
Administrator has not prOVided suffi-
cient data to furnish a. basis for these
regulations in a pa.rticula.r community,
the community sha.ll obtain, review,
and reasonably utilize data a.va.ila.ble
from other Federal, State or other
sources pending receipt of data. from
the Administrator. However, when spe-
cia.l mudsUde (i.e., mudnow) ha.za.rd
a.rea designations have been furnished
by the Administrator, they shall a.pply.
The symbols defining such specla.l
mudslide (i.e., mudflow) ha.za.rd des-
ignations are set forth in f64.3 of this
subchapter. In all cases. the minimum
requirements for mudsllde {I.e.. mud-
flow)-prone areas adopted by a partlcu-
la.r community depend on the amount
of technical data prOVided to the com-
munity by the Admlnistra.tor, Mini-
mum standards for communities are u
follows;
(a.) When the Administrator has not
yet identified any area within the com-
munity as an area having special
mudsllde (I.e.. mudl1ow) ha.za.rds. but
the community hu indicated the pres-
ence of such ha.za.rds by submlttinr a.n
application to participate In the Pro-
gram. the communi ty sha.ll .
(1) Require permits for a.ll proposed
construction or other development in
the community so that It may deter-
mine whether development is proposed
within mudsllde (I.e.. mudflow)-prone
area.s;
