Lipton <br />Director, Business Services <br />University of Colorado at Boulder <br />Campus Box 317 <br />Boulder, CO 80309-0317 <br /> <br />Dear Jeff: <br /> <br />This letter is in response to your letter ofJune 10, 1997, regarding the dike or levee at the <br />University of Colorado property, also referred to as the Flatirons Property or the Deepe <br />Farm Pit. We understand that your agent is seeking a technical revision to the present <br />reclamation plan from the Division of Minerals and Geology in order to raise portions of <br />the levee to provide four feet of freeboard above the IOO-year flood profile. You asked <br />my opinion on three subjects. Your questions and my responses are provided below. <br /> <br />1, You asked "Whether the dike should remain in place, and, if so, whether the <br />lower portions of the dike should be raised to a level at least four feet above the <br />base flood level." <br /> <br />We believe that this dike, or levee as we prefer to ca1l it, should definitely remain <br />in place unless or until an alternative flood control or flood mitigation strategy is <br />in place. The requirements of the Federal Emergency Management Agency <br />(FEMA) regarding recognition or certification of a levee include a requirement <br />for a minimum of three feet of freeboard above the base flood (IOO-year flood). <br />At a meeting convened by the Colorado Water Conservation Board (CWCB) at . <br />the Boulder County Court House, which you and I both attended, representatives <br />from the Flatiron Companies offered to add a foot to the freeboard, making a <br />total offour feet, to account for potential inadequacies in past hydrologic <br />analyses of South Boulder Creek. We felt that that offer was a prudent one and <br />we supported it. The actual parameters for the raising of the levee were <br />established in a subsequent meeting held in our office which was attended by <br />representatives from CWCB and Flatirons. We continue to support Flatirons' <br />offer off our feet although FEMA only requires three feet. <br /> <br />2.
