<br /> <br />The above immediate action program recommendations have been adopted by the land <br />Use Commission and are submitted for consideration by the Governor and the General <br />Assembly in the 1972 session. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />. REQUIREMENTS <br /> <br />Certification of specific environmental concerns through the Colorado land Use Com- <br />mission or certification by a Board of County Commissioners would be required prior to <br />sale of lots in subdivisions covered by the act. This coverage would include subdivisions <br />of three or more lots except those in which all lots were larger than forty acres or in <br />which less than ten lots remain to be sold, so long as these lots represent less than ten <br />per cent of the total lots of the subdivision. It also exempts subdivisions which the local <br />government certifies to have met requirements of the land Sales Act. The act specHies <br />application data and procedures and a fj ling fee of one dollar per lot, with a $100 <br />minimum. Also, submission requirements include adequate evidence covering the <br />fo Ilowi ng: <br /> <br />. Documentation of Water <br />Supply <br /> <br />. Documentation of Sewage Disposal <br /> <br />. Documentation of Geology <br />Topography and Soils <br /> <br />. Documentation of adequate water supply and an opinion from the state engineer <br />regarding same. <br /> <br />. Documentation on methods for, and adequacy of, sewage treatment and disposal. <br /> <br />. Documentation of geological, topographical, and soils conditions identifying <br />existing or potential hazardous conditions, or areas requiring special precautions. <br /> <br />. Administration <br /> <br />In addition, the act provides: <br /> <br />. That the Colorado land Use Commission shall administer the act and has 45 days <br />to review each application for certification. The act also specifies the rejection <br />procedures and makes provision for hearings and amended applications, and <br />defines the general powers and duties of the land Use Commission to carry out the <br />act. <br /> <br />. Penalties <br />. Appropriation <br /> <br />. For civil remedy, penalties, and fines for non-compliance. <br /> <br />. For an appropriation to the land Use Commission for administration for the first <br />year. Thereafter, it is presumed that the fees will cover the cost of administration. <br /> <br />. For more complete review and control of the subdivision and sale of Colorado <br />lands than could be achieved by revision to Chapter 106 eR.S. alone. <br /> <br />.
