<br />proposalform will state the time in which the project' <br />must be completed, the amount of the proposal, <br />guaranty, and the date, time and place of the opening' <br />of proposals. <br />All papers bound with or attached to the proposal' <br />form are considered a part of the proposal and must <br />not be detached or altered when the proposal is! <br />submitted. <br />The plans, specifications and other documentsl <br />designated in the proposal form, will be considered a. <br />part of the proposal whether attached or not. <br />The prospective bidder shall pay the Division the: <br />sum stated in the Invitation for Bids for each set of <br />plans. <br /> <br />102.03 Issuance of Proposal Forms. Thei <br />.Division reserves the right to disqualify or refuse to! <br />issue a proposal form to a bidder for any of the' <br />following reasons: i <br />(a) Lack of competency and adequate machin.' <br />ery, plant and other equipment, as revealed' <br />by the financial statement and experience <br />questionnaire required under subsection <br />102.01. <br />(b) Uncompleted work on other projects which,' <br />the Division, determines will hinder or <br />prevent the prompt completion of additiona~ <br />work. . <br />(c) Failure to pay, or satisfactorily settle, all <br />bUls due for labor and material on formet <br />contracts in force at the time of issuance of <br />proposal forms. <br />(d) Failure to comply with any prequalification <br />regulation of the Division. <br />(e) Default under previous contracte. . <br />(f) Unsatisfactory performance on previou$ <br />work. ! <br />(g) Failure to make timely submittal of required <br />forms per contract provisions on previous or <br />ongoing Contracts. <br /> <br />102.04 Interpretation of Quantities in Pro- <br />posal Form. Except as otherwise provided in this <br />subsection and the method of measurement for <br />individual items, the quantities appearing in the <br />proposal form are estimates prepared for the com- <br />parison of proposals. Payment to the Contractor will <br />be made in accordance with the following <br />procedures. <br />(a) Measurement Required. When the Contract <br />requires measurement of work performed or <br />material furnished, payment will be made flir <br />actual quantities measured and accepted. , <br />. (b) Measurement Not Required. When th~ <br />Contract does not require quantities of work <br />performed or materials furnished to b~ <br />measured, payment will be made for the <br />quantities appearing in the Contract. <br />The estimated quantities of work to be performed <br /> <br />and materials to be furnished may be increased, <br />decreased or omitted. <br /> <br /> <br />102.05 Interpretation of Plans and Specifi- <br />cations. Any change to proposal forms, plans, or <br />specifications prior to the opening of proposals will <br />be issued by the Division by certified mail to all <br />holders of proposal forms. Certain individuals are <br />named in the project specifications, having <br />authority to provide information, clarification or <br />interpretation to bidders prior to opening of <br />proposals. Information obtained from other than <br />those named individuals is invalid. <br /> <br />102.06 Examination of Plans, Specifi- <br />cations, Special Provisions, and Site of Work. <br />The bidder is expected to examine the site of the <br />proposed work, the proposal, plans, specifications, <br />supplemental specifications, special provisions, and <br />contract forms, before submitting a proposal. The <br />submission of a proposal will be considered con- <br />clusive evidence that the bidder has made this <br />examination and is aware of the conditions to be <br />encountered in performing the work according to the <br />Contract. <br />Boring logs and other records of subsurface <br />investigations are available for inspection by <br />bidders. These logs and records are made available <br />so that all bidders have access to identical sub- <br />surface information that is available to the Division, <br />and is not intended as a substitute for personal <br />investigation, interpretation and judgment of the <br />bidders. <br />The Division does not warrant the adequacy of <br />boring logs and other records of subsurface in. <br />vestigations, and such information is not considered <br />to be a part of the Contract. When a log of test borings <br />is included in the subsurface investigation record, <br />the data shown in the individual log of each test <br />boring apply only to' that particular boring and are <br />not intended to be conclusive as to the character of <br />any material between or around test borings. If <br />bidders use this information in preparing a proposal, <br />it is used at their own risk, and bidders are <br />responsible for all conclusions, deductions, and <br />inferences drawn from such information. <br />Bidders may conduct subsurface investigations at <br />the project site at bidder's expense. The Division will <br />afford them this opportunity prior to public opening <br />of proposals. <br />If a bidder discovers an apparent error or omission <br />in the Contract, the bidder shall immediately notify <br />the Engineer to enable the Division to make any <br />necessary revisions. The Division may consider it to be <br />detrimental to the Division for a bidder to submit an <br />obviously unbalanced unit bid price. <br /> <br />6 <br />
