<br /> <br />102.07 Preparation of Proposal. The bid- <br />der shall submit the proposal upon the forms <br />fumished by the Division. The bidder shall specify a <br />unit price in words or figures, or both if required, for <br />each pay item for which a quantity is given and shall <br />also show the products of the respective unit prices <br />and quantities written in figures in the column <br />provided for that purpose and the total amount of the <br />proposal obtained by adding the amounts of the <br />several items. All of the words and figures shall be in <br />ink or type. In case of a discrepancy between the <br />prices written in words and those written in figures, <br />the prices written in words shall govem. <br />When an item in the proposal contains a choice to <br />be made by the bidder, the bidder shall indicate his <br />choice in accordance with the proposal for that <br />particular item. <br />The bidder's proposal must be signed with ink by <br />the individual, by one or more members of the <br />partnership, by one or more members or officers of <br />each firm representing a joint venture, or by two <br />officers of a corporation, or by an agent of the <br />Contractor legally qualified and acceptable to the <br />Division. If the proposal is made by an individual, <br />the individual's name and post office address must <br />be shown; by a partnership, the name and post office <br />address of each partnership member must be shown; <br />as a joint venture, the name and post office address <br />of each membsr or officer of the firms represented by <br />the joint venture must be shown; by a corporation, <br />the name of the corporation and the business address <br />of its corporate officials must be shown. <br />A proposal may be executed for an individual, a <br />partnership, a corporation or a joint venture by <br />anyone having a power of attomey, provided a copy <br />of the power of attomey is attached to the proposal or <br />is previously filed with the Division. <br /> <br /> <br />102.08 Irregular Proposals. Proposals will be <br />considered irregular and may be rejected for any of <br />the following reasons: <br />(a) If the proposal is on a form other than that <br />fumished by the Division; or if the form is <br />altered or any part thereof is detached. <br />(b) If there are unauthorized additions, condi- <br />tional or alternate proposals, or irregular- <br />ities of any kind which make the proposal <br />incomplete, indefiuite, or ambiguous. <br />(c) If the bidder fails to acknowledge in the <br />proposal the receipt of any or all revisions <br />current on the date of opening of proposals. <br />(d) If the proposal does not contain a unit price <br />for each pay item listed except in the case of <br />authorized. altemate pay items. <br />(e) If the Division determines that any of the <br />unit bid prices are materially unbalanced to <br />the potential detriment of the Division. There <br />are two types of unbalanced bids: (1) mathe- <br />matically unbalanced and, (2) materially <br />unbalanced. The mathematically un- <br /> <br />balanced bid can be defined as a bid <br />containing lump sum or unit bid items which <br />do not reflect reasonable actual costs plus a <br />reasonable proportionate share of the bid- <br />der's anticipated profit, overhead costs, and <br />other indirect costs, but not necessarily to the <br />detriment of the Division. These costs should <br />all relate to the performance of the items in <br />question. The materially unbalanced bid is a <br />mathematically unbalanced bid which <br />leaves resonable doubt that award will result <br />in the lowest ultimate cost to the Division or <br />that award is in the public interest. <br /> <br />102.09 Proposal Guaranty. A proposal will <br />not be read and will be rejected unless accompanied <br />by a guaranty of the character and in an amount not <br />less than the amount indicated in the Invitation for <br />Bids. <br /> <br />102.10 Delivery of Proposals. Each prop- <br />osal shall be submitted in a sealed envelope plainly <br />marked to clearly indicate its contents. When mailed, <br />the sealed proposal shall be addressed to the <br />Division at the address and in care of the official in <br />whose office the proposals are to be received. All <br />proposals shall be filed prior to the time and at the <br />place specified in the Invitation for Bids. Proposals <br />received after the time specified will be retumed to <br />the bidder unopened. <br /> <br />102.11 Withdrawal or Revision of Prop- <br />osals. A bidder may withdraw or revise a proposal <br />after it has been deposited with the Division. With- <br />drawal of proposals may be made either in writing or <br />in person; however, any proposal withdrawn for the <br />purpose of revision must be re-deposited before the <br />time set for opening of proposals. Proposals may not <br />be withdrawn after the time set for opening of <br />proposals. <br /> <br />102.12 Combination or Conditional Prop- <br />osals. If provided for proposals may be issued for <br />projects in combination and/or separately, so that <br />proposals may be submitted either on the comb- <br />ination or on separate units of the combination. The <br />Division reserves the right to make awards on <br />combination or separate proposals to the advantage <br />of the Division. Combination proposals will be con- <br />sidered, only when specified. <br /> <br />102.13 Public Opening of Proposals. Prop- <br />osals will be opened and read publicly at the time and <br />place indicated in the Invitation for Bids. <br /> <br />102.14 Disqualification of Bidders. Either <br />of the following reasons will be considered sufficient <br />for disqualifying a bidder and the rejection of the <br />bidder's proposal or proposals: <br /> <br />7 <br />
