I I I I I I I I I I I I I I I I I I ing of such bonds is stipulated hereinafter in Article 9, the cost shall be included in the Bid. 7.1.2 If the Owner has reserved the right to require that bonds be furnished subsequent to Ihe execution of the Contract, Ihe cost shall be adjusted as provided in the Contract Documents. 7.1.3 If the Owner requires that bonds be obtained from other than the Bidder's usual source, any change in cost will be adjusled as provided in the Contract Documents. 7.2 TIME OF DELIVERY AND FORM OF BONDS 7.2.1 The Bidder shail deliver the required bonds to the Owner not later than the date of execution of the Con- tract, or if the Work is to be commenced prior thereto in response to a letter of intent. the Bidder shall, prior to commencement of the Work, submit evidence satisfactory to the Owner that such bonds will be furnished. 7.2.2 Unless otherwise required in Article 9, the bonds shall be written on AlA Document A311, Performance Bond and Labor and MaleriaJ Payment Bond. 7.2.3 The Bidder shall require the attorney-in-fact who executes the reqUired bonds on behalf of the surety to affix thereto a certified and current copy of his power of attorney. ARTICLE 8 FORM OF AGREEMENT BETWEEN OWNER AND CONTRACTOR 8.1 FORM TO BE USED 8.1.1 Unless otherwise required in the Bidding Docu- ments. the Agreement for the Work will be written on AlA Document A101, Standard Form of Agreement Be- tween Owner and Contractor, where the basis of payment is a Stipulated Sum. ARTICLE 9 SUPPLEMENTARY INSTRUCTIONS 1. See Supplementary Conditions for requirements regarding Insurance, Completion Time, Liquidated Damages, Retainage, Performance and Payment Bonds, etc. 2. Each bid must be accompanied by a bid bond or a certified check in the amount of 5% of the Bid. 3. The total price for each bid item shall include all labor, materials, equipment and incidental items and performing all operations necessary to complete the work for each bid item in accordance with the Drawings and Specifications, including any equipment mobilization and demobilization, bonds, excavation, backfill, surface restoration, seeding, installation of gravel base, etc. 4. The Bidder is required to examine carefully the site of the proposed work, the Proposal, Plans and Specifications. He shall satisfy himself as to the character, quality and quantities of work to be performed, materials to be furnished and the requirements of these Specifications. The submission of a Proposal shall be evidence that the Bidder has made such an examination. 5. Contracts-Award-Preference: Contracts for the purchase of goods or services and the construction of works of public improvement shall be awarded to the lowest responsible bidder.
