In considering the responsibility of each bidder for the purchase of goods and
services or a contract for the construction of work of public improvements, the
Town may consider the following: after purchase costs, including but not limited
to warranties, the availability and cost of service, transportation costs, if applicable
for delivery of goods to Meeker, if not included in the bid price; the contractor's
ability to acquire bid, payment and performance bonds; the contractor's ability to
obtain and maintain in good standing during the project construction it liability or
professional errors and omissions insurance coverage and limits of such
coverage. The request for price proposal of public works improvement contracts
shall also include three (3) references for construction projects of similar scope,
scale and cost upon which the contractor was employed. The information to be
provided regarding the references shall be; the municipality or other entity for
which the work was performed and completed, the nature of the construction
project, the contract price, year and date when the work was performed and any
other information pertinent to the construction project as determined by the Town
Administrator or Town Board.

Furthermore, when determining the responsibility of such bidder, the Board of
Trustees may consider any and all of the bidder's past performance or
transactions with the Town, if any.

The Owner shall have the right to accept or reject any individual Bid Items on the
Bid Schedule and to adjust the Total Bid Price accordingly.
