<br />given verbal endorsement for the designation and approval of the approximate floodplain <br />information for the streams as set forth in this resolution; and <br /> <br />WHEREAS, Huerfano County, Colorado, has not requested the Colorado Water <br />Conservation to rescind any of the detailed floodplain information contained in Resolution No. <br />249; and <br /> <br />WHEREAS, Section 37-60-106(1)( c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; <br />and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide <br />that legislative bodies of local jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after designation and approval by <br />the Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or <br />basins and to make such designations available to legislative bodies ofJocal jurisdictions; and <br /> <br />WHEREAS, the approximate floodplain information in said new mapping meets the <br />requirements for approximate information listed tmder the Board's "Ru1es and Regulations for <br />the Designation and Approval of Floodplains and of Storm or Floodwater Runoff Channels in <br />Colorado" (2 CCR 408-1), by virtue of Huerfano County's requirement that a hydrologic and <br />hydraulic analysis be perfonned by a professional engineer prior to floodplain development; and <br /> <br />WHEREAS, Huerfano County has been rlotified herein that floodplain areas of lakes, <br />ponds, local storm drainage areas, and overflows from irrigation ditches and canals may not be <br />designated as approximate floodplain information without a procedure for estimating 100-year <br />hydrologic information, and Huerfano County understands and agrees that a detailed hydrologic <br />and hydrau1ic study shou1d be performed by a professional engineer and submitted by the <br />developer or the development proponent prior to allY floodplain development in those cases; and <br /> <br />WHEREAS, the Colorado Water Conservation Board has determined that the <br />hydrologic methodology developed in the Guidelines for Determining 100- Year Flood Flows <br />for Approximate Floodplains in Colorado, by reference herein, is appropriate for the purpose <br />of designation and approval of approximate floodplain information, but that the methodology is <br />not appropriate for use with development involving residential subdivisions greater than 50 lots <br />or occurring on sites greater than 5 acres, conunercial construction, industrial construction, <br />construction of public transportation facilities or construction of flood control activities; and <br /> <br />4 <br />
