~~-- I We have had several meetings with representatives of the Corps of Engi- neers and agreement has been reached as to a plan of operation which would not interfere with the flood control provi- sions originally planned for this reser- voir. At the recent meeting in Omaha, changes in the plan of operation were tentatively agreed to, subject to approval by the Chief Engineer of the Corps. We had heretofore submitted our recommendations for changes in the said plan of operation, which were not ob- jected to by the Corps and had the tenta- tive approval of the Chief Engineer. During the winter and spring of 1957-58 more water has been accumulated in Cherry Creek Reservoir and there are now in stor- age approximately 8,700 acre feet. This accumulation is the result of excessive run-off in the South Platte Basin to the extent that no demand has been made for water by appropriators and the water now in the Cherry Creek Reservoir may now be construed as belonging to the owners there- of. Since the Department of Game and Fish are making a claim to 10,000 acre feet for recreational purposes, it appears that they may legally lay claim to the water now in storage, since no other entity is in a position to claim and put to beneficial use the water now in Cherry Creek Reser- voir. I At a recent meeting held in the Gover- nor's office, representatives of the Corps of Engineers, Fish and Wildlife Service, State Game and Fish Department, the Gover- nor, and this Department endeavored to con- summate the operational plan for the reten- tion of 10,000 acre feet in the reservoir, to be operated by the State Game and Fish Department as a recreational area.
