<br />~~-- <br /> <br />I <br /> <br />We have had several meetings with <br />representatives of the Corps of Engi- <br />neers and agreement has been reached as <br />to a plan of operation which would not <br />interfere with the flood control provi- <br />sions originally planned for this reser- <br />voir. <br /> <br />At the recent meeting in Omaha, <br />changes in the plan of operation were <br />tentatively agreed to, subject to <br />approval by the Chief Engineer of the <br />Corps. We had heretofore submitted our <br />recommendations for changes in the said <br />plan of operation, which were not ob- <br />jected to by the Corps and had the tenta- <br />tive approval of the Chief Engineer. <br /> <br />During the winter and spring of 1957-58 <br />more water has been accumulated in Cherry <br />Creek Reservoir and there are now in stor- <br />age approximately 8,700 acre feet. This <br />accumulation is the result of excessive <br />run-off in the South Platte Basin to the <br />extent that no demand has been made for <br />water by appropriators and the water now <br />in the Cherry Creek Reservoir may now be <br />construed as belonging to the owners there- <br />of. Since the Department of Game and Fish <br />are making a claim to 10,000 acre feet for <br />recreational purposes, it appears that they <br />may legally lay claim to the water now in <br />storage, since no other entity is in a <br />position to claim and put to beneficial <br />use the water now in Cherry Creek Reser- <br />voir. <br /> <br />I <br /> <br />At a recent meeting held in the Gover- <br />nor's office, representatives of the Corps <br />of Engineers, Fish and Wildlife Service, <br />State Game and Fish Department, the Gover- <br />nor, and this Department endeavored to con- <br />summate the operational plan for the reten- <br />tion of 10,000 acre feet in the reservoir, <br />to be operated by the State Game and Fish <br />Department as a recreational area.
