The existing structure suffered severe damage in 1995 and again in 1999,
when the river cut around the south abutment. G.A.S.P. from Fort Morgan, Colorado was retained by the Ditch
Company to prepare the final design plans and specifications to construct a new 200-ft. long concrete diversion
structure, involving lOO-ft. of Obermeyer pneumatic gates and lOO-ft of a concrete short wall, with a 16-ft. long
downstream flat slab jump basin. The Contractor, Boone Excavating, out of Fort Morgan, Colorado,
commenced construction in late August 2000 and completed the project in November of 2000. The Jackson
Lake Reservoir and Irrigation Company has amended their existing loan contract to cover an additional
construction cost overrun of $55,000. The amended loan contract is anticipated to be completed in February of
200 1 with substantial completion tentatively set for March 200 l.

7. The storage restriction was due to
excessive seepage and the poor condition ofthe spillway. Harrison Western Construction, and designlbuild group
out of Denver, Colorado, was retained by the Town to design and construct the necessary improvements to restore
the dam to its original storage capacity of 230 acre-feet. The proposed improvements include, constructing a
compacted earthfill liner on the upstream slope of the reservoir and floor, construct new toe drains, raise the
embankment dam crest by 2.5-ft., place rip rap and liner protection material above the earthfillliner, spillway
repairs, and fill the old borrow pit within the reservoir. Harrison Western Construction has commenced
construction in rehabilitating the dam face and will continue working as weather permits. Project is anticipated to
be completed in the Fall of2001.

8.
