7.53 Public Agency Recommendations. Prior to ac-
qU1r1ng any conditional water right, the Board shall request
recommendations from the Division of Wildlife, the Division of
Parks, the United States Department of Agriculture and the United
States Department of Interior. The Board may also request com-
ments from other interested parties as it deems appropriate.

7.60 Board Action to Acquire Adjudicated Conditional
Water Rights. The Board shall hold a public meeting prior to ac-
quisition of an adjudicated conditional water right. At the
public meeting the Board shall consider all presentations of
staff, other public agencies and all public comments. After such
consideration, the Board may acquire, acquire with limitations or
reject the proposed acquisition. In the event the Board acquires
an adjudicated conditional water right in either its original or
modified version, the Board may on a case by case basis make the
following findings:

7.61 That a natural environment will be preserved at
least to a reasonable degree by the water available for the ac-
quisition to be made.

7.62 That there is a natural environment that can be
preserved at least to a reasonable degree by the acquisition.

7.63 That such environment can exist without mate-
rial injury to water rights.

8.00 Inundation of Board IFNL Rights.

8.10 Approval to Inundate. No person may cause the
inundation of any portion of an IFNL right without first getting
Board approval to inundate the rFNL stream reach or lake. The
applicant seeking to inundate must seek Board approval prior to
causing an inundation or at the time a water court application is
filed in which the applicant seeks a water right that would inun-
date an IFNL right. The Board after following the procedure set
forth in these regulations may approve the request, approve the
request with limitations, terms and conditions or may deny the
