When <br />such comments are made, staff shall summarize these comments to <br />the Board during staff's presentation on the proposed acquisi- <br />tion. <br /> <br />(b) <br />directly to the Board <br />by the Board prior to <br /> <br />Oral and/or written comments may be made <br />during the public meeting to be conducted <br />taking action on the proposed acquisition. <br /> <br />. <br /> <br />7.53 Public Agency Recommendations. Prior to ac- <br />qU1r1ng any conditional water right, the Board shall request <br />recommendations from the Division of Wildlife, the Division of <br />Parks, the United States Department of Agriculture and the United <br />States Department of Interior. The Board may also request com- <br />ments from other interested parties as it deems appropriate. <br /> <br />7.60 Board Action to Acquire Adjudicated Conditional <br />Water Rights. The Board shall hold a public meeting prior to ac- <br />quisition of an adjudicated conditional water right. At the <br />public meeting the Board shall consider all presentations of <br />staff, other public agencies and all public comments. After such <br />consideration, the Board may acquire, acquire with limitations or <br />reject the proposed acquisition. In the event the Board acquires <br />an adjudicated conditional water right in either its original or <br />modified version, the Board may on a case by case basis make the <br />following findings: <br /> <br />7.61 That a natural environment will be preserved at <br />least to a reasonable degree by the water available for the ac- <br />quisition to be made. <br /> <br />7.62 That there is a natural environment that can be <br />preserved at least to a reasonable degree by the acquisition. <br /> <br />7.63 That such environment can exist without mate- <br />rial injury to water rights. <br /> <br />8.00 Inundation of Board IFNL Rights. <br /> <br />8.10 Approval to Inundate. No person may cause the <br />inundation of any portion of an IFNL right without first getting <br />Board approval to inundate the rFNL stream reach or lake. The <br />applicant seeking to inundate must seek Board approval prior to <br />causing an inundation or at the time a water court application is <br />filed in which the applicant seeks a water right that would inun- <br />date an IFNL right. The Board after following the procedure set <br />forth in these regulations may approve the request, approve the <br />request with limitations, terms and conditions or may deny the <br /> <br />. <br /> <br />-9- <br />
