The Board shall not operate an acquired water <br />right in such a manner which would impair or in any way inhibit <br />the operation of an exchange or conditional exchange beyond the <br />extent of the impact that would have arisen as a result of exer- <br />cise of the original conditional right. <br /> <br />(a) Any acquisition of a conditional water <br />right is subject to terms and conditions of the donation agree- <br />ment in which the Board agreed to acquire the subject conditional <br />water right as long as the acquisition agreement is consistent <br />with the other negotiations dealing with the acquisition of con- <br />ditional rights. <br /> <br />(b) Any operational limitation on exercise of <br />the conditional water rights shall be incorporated into the de- <br />cree for the changed water right. <br /> <br />7.50 Public Review Process. The following public review <br />process shall be followed by the Board prior to acquiring any <br />existing adjudicated conditional water right. <br /> <br />7.51 Public Notice. <br />to the meeting in which the Board <br />staff shall cause a notice of the <br />mailed to the following persons: <br /> <br />Approximately thirty days prior <br />considers the acquisition, <br />proposed acquisition to be <br /> <br />(a) Any other persons requesting notification. <br /> <br />(b) The county commissioners of the county in <br />which a subject stream lake is located. <br /> <br />(c) Any name supplied through consultation <br />with the Division Engineer. Staff shall ask the Division Engi- <br />neer to identify those persons, landowners, governments, special <br />districts and water users who might desire additional notice. <br />, <br /> <br />(d) Failure to notify any person pursuant to <br />this section shall not invalidate any Board action nor shall lack <br />of notice be a ground for contesting the water right applied for <br />by the Board. <br /> <br />7.52 Public Comment. Members of the public shall be <br />entitled to comment on the proposed acquisition prior to Board <br />action to acquire the existing water right in any or all of the <br />following manners: <br /> <br />(a) Oral or written comments may be directed <br /> <br />-8- <br />
