<br />. <br /> <br />71-1J- DR AFT <br /> <br />. <br /> <br />(c) If the Board elects to combine or stack <br />the conditional water right, the details of how the water rights <br />are to be combined with other existing instream flow water rights <br />must be set forth in the decree for the changed conditional <br />right. <br /> <br />7.20 Evaluation and identification of effects caused <br />by acquisition of an adjudicated conditional water right. Prior <br />to the acquisition of an existing conditional water right the <br />Board must evaluate and identify the effects caused by such ac- <br />quisition on the following interests and water rights that are <br />upstream of or within the proposed instream flow reach that will <br />receive the water from the acquired conditional water right. <br /> <br />(a) Existing absolute water rights. <br />(b) Existing exchanges. <br /> <br />(c) <br />which facilities have <br />under construction. <br /> <br />Existing conditional water rights for <br />been constructed or which are substantially <br /> <br />(d) Future development of Colorado's Inter- <br />state Compact entitlements. <br /> <br />. <br /> <br />(e) The ability to ensure that Colorado water <br />resources can be developed and placed to beneficial use in a cost <br />effective and responsible fashion. <br /> <br />7.30 Significant Negative Effect Limitation. Should <br />the evaluation referred to in Section 7.20 identify a significant <br />negative effect to any of the water rights or interests set forth <br />in Section 7.20(a)-(c) the Board shall not acquire the subject <br />conditional water right. The Board shall not acquire an adjudi- <br />cated conditional right if that right adversely affects the <br />interests set forth in Section 7.20(d)-(e), but in deter~ining <br />whether the conditional right adversely affects the interests in <br />Section 7.20(d)-(e) the Board shall balance any significant nega- <br />tive effect against the environmental benefits of acquiring the <br />right. <br /> <br />(a) The determination of significance shall be <br />made on a case-by-case basis taking into account the need to <br />refrain from injuring existing beneficial uses, the need to pro- <br />tect for future beneficial use, Colorado's interstate compact en- <br />titlements and the need to ensure that Colorado water resources <br />can be developed and placed to beneficial use in a cost effective <br />and responsible manner. <br /> <br />-7- <br /> <br />. <br />
