The Board shall hold a public meeting prior to acquisi- tion of an adjudicated absolute water right. At the public meet- ing the Board shall consider all presentations of staff, other public agencies and all public comments. After such considera- tion, the Board may acquire, acquire with limitations or reject the proposed acquisition. In the event the Board acquires an ad- judicated absolute water right in either its original or modified version, the Board may on a case by case basis make the following findings: 6.31 That a natural environment will be preserved at least to a reasonable degree by the water available for the ac- quisition to be made. 6.32 That there is a natural environment that can be preserved at least to a reasonable degree by the acquisition. 6.33 That such environment can exist without mate- rial injury to water rights. 7.00 Acquisition of Adjudicated Conditional Water Rights. The Board may acquire conditional water rights for change to ab- solute instream flow water rights after identification and evalu- ation of the effects the potential acquisition would have on existing water uses and on future development of Colorado's com- pact entitlements. 7.10 Stacking Evaluation. Prior to the acquisition of any conditional water right, the Board shall evaluate whether it would be appropriate to combine or stack the conditional water right with any other instream flow water right in order to achieve the minimum flow necessary to preserve the natural envi- ronment to a reasonable degree. (a) Water rights shall not be combined or stacked in such a manner so as to cause the total instream flow rights to exceed the minimum flow necessary to preserve the natu- ral environment to a reasonable degree. (b) Acquired conditional rights shall be oper- ated in combination with other instream flow rights to insure that the total instream water rights would not exceed the minimum flow necessary to preserve the natural environment to a reason- able degree. -6-
