The Board shall hold a public meeting prior to acquisi- <br />tion of an adjudicated absolute water right. At the public meet- <br />ing the Board shall consider all presentations of staff, other <br />public agencies and all public comments. After such considera- <br />tion, the Board may acquire, acquire with limitations or reject <br />the proposed acquisition. In the event the Board acquires an ad- <br />judicated absolute water right in either its original or modified <br />version, the Board may on a case by case basis make the following <br />findings: <br /> <br />6.31 That a natural environment will be preserved at <br />least to a reasonable degree by the water available for the ac- <br />quisition to be made. <br /> <br />6.32 That there is a natural environment that can be <br />preserved at least to a reasonable degree by the acquisition. <br /> <br />6.33 That such environment can exist without mate- <br />rial injury to water rights. <br /> <br />7.00 Acquisition of Adjudicated Conditional Water Rights. <br />The Board may acquire conditional water rights for change to ab- <br />solute instream flow water rights after identification and evalu- <br />ation of the effects the potential acquisition would have on <br />existing water uses and on future development of Colorado's com- <br />pact entitlements. <br /> <br />7.10 Stacking Evaluation. Prior to the acquisition <br />of any conditional water right, the Board shall evaluate whether <br />it would be appropriate to combine or stack the conditional water <br />right with any other instream flow water right in order to <br />achieve the minimum flow necessary to preserve the natural envi- <br />ronment to a reasonable degree. <br /> <br />(a) Water rights shall not be combined or <br />stacked in such a manner so as to cause the total instream flow <br />rights to exceed the minimum flow necessary to preserve the natu- <br />ral environment to a reasonable degree. <br /> <br />(b) Acquired conditional rights shall be oper- <br />ated in combination with other instream flow rights to insure <br />that the total instream water rights would not exceed the minimum <br />flow necessary to preserve the natural environment to a reason- <br />able degree. <br /> <br />-6- <br />
