The following public review <br />process shall be followed by the Board prior to acquiring any ad- <br />judicated absolute water right. <br /> <br />6.21 Public Notice. <br />to the meeting in which the Board <br />staff shall cause a notice of the <br />mailed to the following persons: <br /> <br />Approximately thirty days prior <br />considers the acquisition, <br />proposed acquisition to be <br /> <br />(a) Any persons requesting notification. <br /> <br />(b) The county commissioners of the county in <br />which a subject stream lake is located. <br /> <br />(c) Any name supplied through consultation <br />with the Division Engineer. Staff shall ask the Division Engi- <br />neer to identify those persons, landowners, governments, special <br />districts and water users who might desire additional notice. <br /> <br />. <br /> <br />(d) Failure to notify any person pursuant to <br />this section shall not invalidate any Board action nor shall lack <br />of notice be a ground for contesting the water right applied for <br />by the Board. <br /> <br />6.22 Public Comment. Members of the public shall be <br />allowed to comment on the proposed acquisition prior to Board ac- <br />tion to acquire the adjudicated absolute water right in any or <br />all of the following manners: <br /> <br />(a) Oral or written comments may be directed <br />to staff prior to the staff's presentation to the Board. When <br />such comments are made, staff shall summarize these comments to <br />the Board during staff's presentation on the proposed ac~uisi- <br />tion. <br /> <br />(b) <br />directly to the Board <br />by the Board prior to <br /> <br />Oral and/or written comments may be made <br />during the public meeting to be conducted <br />taking action on the proposed acquisition. <br /> <br />6.23 Public Agency Recommendations. Prior to ac- <br />quiring any conditional water right, the Board shall request <br />recommendations from the Division of Wildlife, the Division of <br />Parks and Outdoor Recreation, the United States Department of Ag- <br />riculture and the United States Department of Interior.
