After receiving the request to inundate, the Staff may seek the recommendations of the Division of Wildlife, Division of Parks and Outdoor Recrea- tion, U.S. Department of Agriculture and U.S. Department of Inte- rior. 8.20 Public Review Process. The following public review process must be followed prior to Board decision to grant approv- al to inundate a CWCB water right. 8.21 Public Notice. Thirty days prior to the meet- ing in which the request to inundate will be presented for Board consideration, staff shall cause a copy of the staff recommenda- tion to be mailed to the following persons: (a) Any persons requesting notification. (b) The county commissioners of the county in which a subject stream reach is located. . (c) Any name supplied through consultation with the Division Engineer. Staff shall ask the Division Engi- neer to identify those persons, landowners, governments, special districts and water users who might desire additional notice. (d) Failure to notify any person pursuant to this section shall not invalidate any Board action nor shall such lack of notice be a ground for defending against Board actions to prevent interference, with its IFNL decree or seek compensation for injury to its IFNL decree. 8.22 Public Comment. Members of the public shall be entitled to comment on the request to inundate prior to Board ac- tion on the recommendation in any or all of the following man- ners: (a) Oral or written comments may be directed to staff prior to the staff's presentation to the Board. When such comments are made, staff shall summarize these comments to the Board during staff's presentation of their recommendation. (b) directly to the Board by the Board prior to Oral and/or written comments may be made during the public meeting to be conducted taking action on the staff recommendation. 8.30 Approval of Request to Inundate.
