After receiving the <br />request to inundate, the Staff may seek the recommendations of <br />the Division of Wildlife, Division of Parks and Outdoor Recrea- <br />tion, U.S. Department of Agriculture and U.S. Department of Inte- <br />rior. <br /> <br />8.20 Public Review Process. The following public review <br />process must be followed prior to Board decision to grant approv- <br />al to inundate a CWCB water right. <br /> <br />8.21 Public Notice. Thirty days prior to the meet- <br />ing in which the request to inundate will be presented for Board <br />consideration, staff shall cause a copy of the staff recommenda- <br />tion to be mailed to the following persons: <br /> <br />(a) Any persons requesting notification. <br /> <br />(b) The county commissioners of the county in <br />which a subject stream reach is located. <br /> <br />. <br /> <br />(c) Any name supplied through consultation <br />with the Division Engineer. Staff shall ask the Division Engi- <br />neer to identify those persons, landowners, governments, special <br />districts and water users who might desire additional notice. <br /> <br />(d) Failure to notify any person pursuant to <br />this section shall not invalidate any Board action nor shall such <br />lack of notice be a ground for defending against Board actions to <br />prevent interference, with its IFNL decree or seek compensation <br />for injury to its IFNL decree. <br /> <br />8.22 Public Comment. Members of the public shall be <br />entitled to comment on the request to inundate prior to Board ac- <br />tion on the recommendation in any or all of the following man- <br />ners: <br /> <br />(a) Oral or written comments may be directed <br />to staff prior to the staff's presentation to the Board. When <br />such comments are made, staff shall summarize these comments to <br />the Board during staff's presentation of their recommendation. <br /> <br />(b) <br />directly to the Board <br />by the Board prior to <br /> <br />Oral and/or written comments may be made <br />during the public meeting to be conducted <br />taking action on the staff recommendation. <br /> <br />8.30 Approval of Request to Inundate.
