<br />e <br /> <br />e <br /> <br />e <br /> <br />Chairman Martineau called the meeting back to order at 1:37 p.m. and there was a <br />quorum. Present were Harrison, Smith, Jackson, Martineau, Sheftel, Wright, Meyring, <br />Simpson, and Duncan. Peter Evans, DNR, represented Ken Salazar, and Jennifer <br />Gimbel, AG's office, represented Gale Norton. Absent were Lochhead, Eisel, and <br />Olson. Eisel arrived at 1:48 p.m. Duncan left at about 3:00 p.rn. <br /> <br />8d/l0d. Grand County Instream Flow Filings, continued (1:37 - 1:42 p.m.) <br /> <br />A motion was made by Harrison and seconded by Jackson to approve the general <br />concept of the contract to the extent that 1) the Board would not seek to improve the <br />position of its existing water rights by the amount of any water introduced by Denver <br />intended for the benefit of the Grand County entities including water that would be <br />diverted from Williams Fork and water that would have either been left in the Fraiser <br />or diverted from other Fraser tributaries and essentially waive any claim for new water <br />from those sources, 2) the Board essentially not attempt to take a position at this time <br />relating to negotiating additional water or any water for Vasquez Creek from the <br />Grand County Water and Sanitation District No.1, and 3) that we authorize our <br />attorney to negotiate particular language to effectuate that general principle and urge <br />that she do so in a way that does not unintentionally involve this Board ratifying or <br />blessing any particular adminiotrative role or way of adminiotering those water rights <br />so we avoid things like whether it's characterized as a subordination or characterized <br />in some other way and we particularly avoid blessing one way of characterizing it <br />rather than another. Discussion followed by Harrison, Duncan, and Jackson. The <br />motion passed by unanimous decision (7-0) with one abstention. David Smith took no <br />part in the discussion and was recused. <br /> <br />20a. ColoradO River Matters, Position Paper of Indian Tribes. (1:42 - 1:57 p.m.) <br /> <br />Gene Jencsok, CWCB staff, reviewed a groundwater recharge plan proposed for metro <br />Ca1ifornia. Jencsok next discussed a position paper developed by the ten Indian Tribes <br />with water rights in the Colorado River Basin with respect to the seven basin states' <br />discussions on the Colorado River. QueStions were asked by Jackson and Duncan. <br />This was an informational item and no action was taken. <br /> <br />20b. Colorado River Matters, 1993 AOP (1:57 - 2:01 p.m.) <br /> <br />Gene Jencsok, CWCB staff, discussed the status of the draft 1993 Annual Operating <br />Plan for the Colorado River System. A meeting of the seven basin states and the <br />Bureau has been scheduled for August 11, 1992. Questions were asked by Jackson and <br />Sheftel.
