I

I

MR. KROEGER: He has asked for an amendment to the motion. Could I
have a second to that? And then we will discuss it.

MR. FETCHER: I will second it.

MR. KROEGER: All right. John.

MR. FETCHER: They have a contract for one cfs, as I understand it.
out of the source of water from the Division of wildlife.

MR. ROBBINS: That is right.

MR. FETCHER: One cfs, theoretically, would handle between 4 and 5.000
people.

MR. ROBBINS: You are the expert, Mr. Fetcher.

MR. FETCHER: Just quantifying the water for everybody's knowledge.

MR. ROBBINS: Yes.

MR. FETCHER: And on that basis I wouldn't see that there would be any
problem with Basalt. unless they have a comment to make on this.

MR. ROBBINS: My concern is only that I don't want an argument to arise
20 years from now when all of us are elsewhere that the state somehow,
through this board, affected a contract that another state agency has.
I am confident that the Town of Basalt doesn't propose. or the present
administration doesn't propose. to affect that contract. I am confi-
dent that their attorney does not. I simply want the record clear
when this board acts on this proposal, because Basalt does intend.
suant to their engineering study. to utilize Luxinger Creek water.
just want the recognition to exist that, in fact, there are rights
owned by the state.

pur-
I
there

MR. KROEGER: Mr. Flewelling.

MR. FLEWELLING: In an attempt to alleviate some of your fears on that
situation, we would like to advise the Board that the Town of Basalt
currently is negotiating with the Division of Wildlife, even the Town
of Carbondale and the Division of Wildlife Fish Hatchery, on the
Crystal River. in an attempt to work out a three-way trade which will
end up being beneficial to everyone. They recognize the prOblem. and
an ongoing effort is being made. It looks like some fruition will be
reached very quickly.

MR. KROEGER: Thank you. Is there any further comment?

MR. VANDEMOER: I would accept that modification.

MR. FURNEAUX: I. too.

MR. KROEGER: All right. All in favor of the amendment say "Aye."
(Ayes.) Those opposed say "No." (NO response.)

-27-
