I would like to recognize at this moment a former member of our <br />board, Mr. John Benton. who has come in. John, would you stand? We <br />are glad to have you with us this morning. <br /> <br />The action that I understand we can now take, if we wish. is to, as <br />a board. approve these projects. We must consider the priorities <br />that have been given to them. We can put on some limitations. such <br />as the permit that was discussed; and I would ask what your pleasure is. <br /> <br />I <br /> <br />MR. VANDEMOER: I would move for approval of the projects in the <br />priority order as listed on this agenda. <br /> <br />MR. FURNEAUX: Second. <br /> <br />MR. KROEGER: Mr. Vandemoer moves that the projects be approved in the <br />priority as listed. and it has been seconded by Mr. Furneaux. Are <br />there any comments or discussion? <br /> <br />MR. ROBBINS: I would like to raise one comment Mr. Chairman. The <br />Division of Wildlife--and this relates to the request of the city of <br />Basalt--the Division of Wildlife owns extensive water rights out of <br />the Luxinger Springs. also called "Luxinger Creek.~' Those rights were <br />purchased with state monies a number of years ago and in most times <br />control a fair portion of the flow of those springs. They are agri- <br />cultural ri~hts. They take water during the irrigation season in <br />priority. There exists at the present time a contract between the <br />Division of'wildlife and the city of Basalt whereby the city of Basalt <br />is authorized to take one cubic foot per second of water out of the <br />Luxinger Springs. They are also allowed by the contract to take that <br />water first if there is only one cfs available. <br /> <br />I am concerned that the State of Colorado's contract with Basalt be <br />honored. I have no indication that it would not be. But I would not <br />want the Board to expend significant funds developing a collection <br />system if, in fact, it were predicated upon the understanding that all <br />of the water in the Luxinger Springs was, in fact, available to the <br />city of Basalt. <br /> <br />I want to make it clear that in the winter season, Basalt can have all <br />the water out of the springs that it needs and has decrees to. And I <br />I would mOve that the additional change be made to the original motion. <br />with the permission of the first and second, that the acceptance of <br />the grant here under discussion be related to the recognition of the <br />Division of wildlife's rights and the validity of their contract and <br />when water is taken in the irrigation season that it is, in fact, <br />taken pursuant to that contract. <br /> <br />MR.
